BBB Response to Customer Review dated 10/28/2023

      Greetings,
Thank you for bringing this matter to our attention and allowing BCHH the opportunity to address your concerns regarding your broker’s commission in securing a loan on your behalf.

I have had an opportunity to read your Better Business Bureau complaint that you submitted regarding your recent refinance transaction for which BCHH acted as settlement agent, and we would like to take a moment to address any concerns that you may have had regarding the transaction itself.

In this instance, your complaint centers on your contention that your broker, Chris F***t, had acted inappropriately by taking an unreasonable broker’s fee of twelve percent (12%) to secure your loan.

It is our understanding that this is the second transaction that you closed with Mr. F***t as your broker.

Title for this order was delivered to your lender on September 6, 2023, and the clear to close was delivered the following day.

A request to schedule closing was sent to you on October 3rd at 3:44PM; you were left a message. You later responded back, and a signing was set for October 5, 2023.

On the day of closing, Chris F***t called BCHH and advised that there was a twelve percent (12%) broker’s fee that would be due out of borrower’s funds.

At closing you signed an updated HUD-1 settlement statement reflecting the broker fee being paid.

The day after the closing you called our office and spoke with our Senior Operations Manager, Melanie M****** expressing that you were upset regarding the broker’s fee that was charged by Chris F***t and that you had “turned Chris into the banking commission.”

You also stated that you are presently unable to speak with Mr. F***t as you had taken out a restraining order against him.

You stated that after the closing and the loan having been funded, Mr. F***t purportedly instructed you that if you weren’t happy to return the wire or BCHH or the lender would recall it. In response to that statement, Melanie informed you that we had never been advised about recalling the wire or cancelling the loan. We would never just recall a wire.

Melanie asked you if you wanted to cancel the day of funding and you indicated that you never had plans to cancel because as soon as you received the funds, you had planned to spend them to cover certain financial obligations.

Regarding your contention that BCHH worked with your broker to deny you money that was owed to you, Melanie also advised you that Mr. F***t is not a part of BCHH, and we do not make commissions off of his orders. The fees we received were disclosed on the initial HUD and the final HUD and only would have changed if a document (deed/release/sub) would have been needed, or if the loan amount changed.

Our office later spoke with Mr. F***t and informed him that you still need the $864 for the appraisal he confirmed that he had your information and should pay you. Chris said he would send you a check.

Finally, Mr. F***t stated that you weren’t happy with the loan and had told you that if you didn’t want the loan to return the funds; you purportedly informed him that you didn’t want to cancel, and that the money was already spent.

To reiterate, BCHH is an independent third-party that acted as the title and settlement company for your transaction, passing information between all parties.  Any dissatisfaction that you may have regarding the broker’s fees for your loan is between yourself and Mr. F***t.

We thank you again for providing BCHH with the opportunity to address the identified concerns.  BCHH strives to provide customers with a first-class experience, and it is unfortunate that not every element of a transaction is under the control of BCHH, your happiness and satisfaction with your broker being one of those instances.

      Sincerely,
      BCHH
