On or about October 1st 2021, DUDA Cable const. Co. was installing a conduit run for a new fiber optic cable for Atlantic Broadband. During construction activities they dug a exit pit for a directional drill; where the exit pit was dug was on the corner marker for my property and my neighbors. Over the last 5 months I have tried repeatedly to get them to relocate the corner marker they vandalized/ destroyed/removed. I have provided the surveyor's contacts who had marked my lot when I purchased it in effort to minimize expense for DUDA. All of these efforts go no where and at this time DUDA REFUSES to replace the corner mark.Business response

The information provided by this customer is completely inaccurate. The damage complaint was brought to our attention on 12/21/2021, which was roughly 2 months after the customer claims it occurred. Given the time span and the fact that other utilities could have possibly been in the area since Duda had completed our work, there is zero proof that this damage was actually caused by Duda Cable. However, the owner of the company operated in good faith and agreed to pay a surveying company to reset the marker as a professional courtesy. A damage waiver, in which Duda agrees to the expense and is therefore relived of any further obligation, was sent to the customer on 12/21/21. When no response was received, a 2nd waiver was resent on 12/22/2021. Again, no response was received. A 3rd waiver was again sent on 1/4/2022. Finally, the customer responded and sent an edited waiver back (attached) on 2/17/2022. The customer had crossed out the majority of our waiver and had a hand written message stating that "Duda Cable still accepts liability should any damages seen or unseen be discovered at a later date". As a business, this is considered unprofessional and an attempt to hold the business hostage for any damages that they may not be liable for. No business would agree to this kind of demand. Again, there was zero proof that we caused this damage to begin with and we were generously offering to cover the expense anyway. Duda responded to the customer that this was unacceptable and we would only compensate should the LEGAL waiver be signed. The customer then called in to our offices repeatedly and harassed, threatened to get the BBB involved and cursed at the receptionist, whom behaved professionally by listening to the customer's venting and offering a solution to resend him a legal waiver so that this matter could be taken care of. Duda decided to cut the customer out of any further contact since the matter was obviously not getting resolved through him and instead contacted the surveyor to go and replace the marker. On 4/19/2022, he surveyor emailed pictures, as well as our paid invoice (attached), as proof that the marker had been reset and work was completed. Duda Cable kept to their word despite and made this matter right.
