We moved into our newly built home 1/2024. The Subfloor of this home began buckling 7/2024. We removed part of the flooring to find black mold growing under the flooring. When we called the builder, they came out and looked at the issues and told us that it was not their problem and we should have had the crawlspace encapsulated and that they see this often in homes in Cottageville, SC. They suggested that we have this done now to the tune of $20k+ to repair and replace the damages and stop further damage. This was never once talked about prior to them giving us the keys nor did they take any steps in the construction phase to ensure that this would not happen. They were negligent and did not preform their due diligence to ensure that our new home would not be a health risk just 6 months after our moving in.Business response

This is simply not true, our contract clearly in large font explains the possibility of humidity moisture under any home build on a crawlspace and the potential need for encapsulation, I have attached the contract pages in question that Mr. and Mrs. E**** signed and initialed. paragraph 2 of page 2 outlines this potential as it is possible anywhere in the lowcountry. I would like to add that we ran all of the hvac overhead at a higher expense to help alleviate this possibility, but this cannot be a complete fix in all soil conditions. I would like to also add that we did not mark the location of the home, this was at the sole discretion of Mr. and Mrs. E****. They were told from the very beginning before permits were even pulled that the home needed to move forward farther away from their septic mound system but they insisted on the location to avoid any expense on their part. The home currently sits exactly where they wanted it which is very close to the water shed of the septic system. The home went threw a thorough inspection process by Colleton county and has adequate venting. I would like to end by saying that we have already given this customer a credit back of several thousand dollars to appease them on other unwarranted claims such as attic decking that has a splice in the wood and missing H clips that were not called for anyway. We went so far as to contact the engineer and architect of the home to guarantee they were not necessary. after the settlement payment they customer still went to Google to voice their 1 star review of the matter. We have never had a BBB complaint in over 5 decades and we don't want one now but at this point we have held to all contractual obligations with Mr. and Mrs. E****.
