Hammertime general contracting is wanting me to pay for an inspection of my roof and photos of my roof that I was told was Free They are stating that they filled for a supplement payment of 30% when absolutely no repairs or work has been scheduled or otherwise has been done. Better Business Bureau Subject: Official Complaint Regarding Breach of Contract by Client ***********************
Dear BBB,
We are writing on behalf of Hammertime General Contracting to formally lodge a counter-complaint against our client, *********************** (also known as ***************************), for a breach of contract. This concerns the property damage claim handling for her residence at *********************************************************, with Claim # I5C0336 and Policy # ************* with Travelers Insurance.
Our initial engagement with Ms. ********** commenced on Wednesday, April 12th, 2023. During this first meeting, we outlined our services and the terms of our engagement. These services included thorough scope of work diligence, estimating, inspections, and producing proprietary documentation essential for a successful settlement of her property damage claim.
Subsequently, Ms. ********** verbally agreed to engage Hammertime General Contracting for the entire loss settlement process, including drafting documentation and scope of work based on our initial inspection. This agreement was formalized on November 5th, 2023 by WRITTEN BINDING CONTRACT. As per the ***** Administrative Code ******, she was provided a 3-day right of rescission, which she did not exercise. The ***** Business and Commerce Code, specifically Chapter 601,
addresses the cancellation of certain consumer transactions. Consumers have the right to cancel the transaction by midnight of the third business day after signing. (*************************************************************)Our team conducted multiple inspections and invested considerable in-field time, labor, overhead, and resources into this project. We successfully fulfilled our commitment by substantiating the loss with the insurance carrier and securing approval for coverage. However, upon discussing her obligations, including the payment of her insurance deductible as required by Insurance Code Chapter 707 and detailed in our agreement, Ms. ********** decided to void her legal commitment. She expressed intentions to employ an alternative party for the production portion of her claim, seemingly to evade her legal and financial responsibilities as we expressed our unwillingness to cooperate with the proposed dishonest activities of committing insurance fraud.
This action not only violates our contractual agreement but also disregards the substantial investment of time and resources Hammertime General Contracting has made in good faith, aside from clear intentions to commit insurance fraud.
Furthermore, at this time, we are considering with our legal counsel that this complaint to the BBB as Libel & Defamation if this is published. In *****, defamation law covers libel (written defamation) and slander (spoken defamation) and applies to both individuals and companies. Under ***** law, a company, like an individual, can be a victim of defamation. This includes both libel and slander. Defamation is defined as an intentional false statement that injures someone's reputation. The ***** Civil Practice and Remedies Code, Chapter 73, specifies rules for defamation.
Attached, you'll find part of our work product associated with the extensive time and efforts put into our hired services.We seek the BBB's intervention to address this breach of contract and assist in resolving this matter fairly and legally. I am rejecting this response because: The attached report is the only report Titled Report-10 is the only thing I have received . The dates submitted on the report today are titled Final Draft with/without Removal Depreciation has never been presented If you look on the dates on starting on pages **** are dated 01/22/24 and pages ***** of the report also say 01/22/24. Not until today 01/22/24 am I receiving these documents. I have asked several times for their estimates and/or proposal and they would not provide them. They stated that they had to have my report from the adjuster to make sure they were getting as much money or me as they could. ********************* tried to include things on the claim that were untrue. One additional thing ********************* stated that he did not need to get on the roof because he had the drone so it was not necessary. If you look at page 9 & 13 on the document labeled Report-10 you can see he is clearly on ******* taking pictures.Business response

I think if you would just pick up the phone with me, as the owner of the company, this would be an easy situation to cure, the fact that your phone number goes straight to voicemail doesn't make sense. Is there an error in your phone number?
The title of the document, and the date of a hail report have nothing to do with the diligence of the report that was created. As someone who is in the insurance industry, you should know the difference such as how the final draft of the scope of work was created on "Date Entered: 11/5/2023 7:33 PM"
The fact of the matter is the diligence has been done, whether acknowledged or not, we have fulfilled our terms of obligation.
Again, a simple phone call to our firm, which we've never received from you, to our office, or response by email, would clear this up. Attempting to substantiate your position with a sales representative that you signed a contract with and failing to communicate with the office is whats causing this inconsistency and uncertainty. I think a 2 minute phone call would put this all to rest.

Subject: Resolution of Complaint Between ************************* and Hammertime General Contracting
Dear Better Business Bureau,
I am writing on behalf of Hammertime General Contracting to inform you of a recent mutual resolution reached with ************************* regarding the complaint previously filed with your organization. After direct communication, both ************************* and Hammertime General Contracting have agreed to retract all complaints and commentary previously submitted to the BBB.
This resolution is contingent upon Hammertime General Contracting absolving ************************* of any obligations under our contract. This includes nullifying any monies owed, services owed, payments owed, and invoices due. Correspondingly, upon the BBB's acknowledgment and removal of the complaint from your records, Hammertime General Contracting will declare the contract with ************************* null and void, thereby relinquishing any claims to payments owed, invoices, and performance requirements.

Hammertime did my roof and did a great job. I hired then to also do my shed paid for by insurance. They were let go from the job after my partner was unhappy with the work. We attempted to put it together ourselves however we noticed it was the wrong shed that was ordered. I contacted them for the receipt and they never got it to me. ******************* has been very unprofessional and unresponsive. I followed up with him today and he sent me the receipt. Because he waited so long to get it to me it is now over the 90 day return window and I am unable to return the incorrect shed. He is not responding to my messages and just does not care. I want this incorrect shed picked up and the money either refunded to me for the new shedBusiness response
