I never agreed or signed my name to any document or contract personally. This company was paid $10,210.00 from ** already we file a claim to repair roof and this interior damage caused by the roof which total per insurance to be a little over $32,000 we received check and informed them that only $5000 was to be paid to them from us to payiff the balance quote by insurance company was $15800. another . Now the company never gave us a Fee of charges , call our homeowners insurance without our permission...then we never heard anything from said company until the day before our second claim check to fix other repairs inside of our home...now company is starting that a roof estimate to cost $13-15000 to be $32000 . This company had us to file a and up the estimate on repairs still not rendered and told us to file another claim to fix the inside our home. Now are threatening us about a lien ..we have documents from our insurance clearly stating the roof estimate to be $15000 and not $32000. Which this company is charging us for our deductible in which the insurance minus in distribution of funds...We have tried calling and resolving this issue..but at no avail.Business response

The current signed contingency agreement on file for the claim in question is for *************************, dated 7/16/22. ************************* is also listed as the policy holder on the scope of work provided by the insurance carrier, we can provide a copy of this agreement at your request. The said contingency agreement terms are as follows, Scope of work to be completed and final price are to be determined upon inspection of final scope of work and receipt of fair market price from insurance company, this means that our pricing comes directly from our customers insurance carrier. Since pricing comes directly from the insurance carrier based upon the scope of work provided, Classic Roofing & Solar does not provide written estimates. CRS received the scope of work provided by this customers carrier, and the *** for the entire claim came to $32,024.96, with the roof *** alone totaling $19,462.71. This customer released their first ACV check in the amount of $10,210.80 in order to get the roof installed, with the final payment being released upon completion of work. However, once the work was completed, the customer decided that they no longer owed CRS any additional funds. As it stands, the customer has an outstanding balance due for the roofing portion in the amount of $9,251.91. Our sales rep has been consistent in communicating with this customer and has provided top notch customer service throughout this process. CRS has gone above and beyond to make a resolve and has only been met with hostility. Legally, the customer is responsible for the deductible portion of every claim. The deductible funds are to be paid to the contractor that completes the work. The payment of the deductible is not Classics rule, its the law. CRS wants nothing more than to settle this issue without pursuing matters any further. We take pride in our work and want to always uphold our belief, which is taking care of our customers and making sure they are happy. At this time, CRS would like to be paid what is owed, nothing more, nothing less.Initial Complaint

On November 16, 2021, Classic Roofing began replacing the roof and decking of our enclosed patio as we had leaks that caused rotted wood to the decking and support studs. the studs and decking were fully exposed and the time of the quote Pictures were taken.The crew went to work and left without saying anything. I went to look at the work and saw that they placed the new decking over the rotted lumber. I immediatly took some photos and sent them to *** "the sales person" he replied that the crew did not know that they were supposed to repair the rotted wood and he would schedulet them to return to make the repairs. I did not heare back from the company.11/22. I sent *** another Text about the reapairs. He responded that he was sending another email to schedule the work. I did not hear back from him.12/2 I sent another text to *** which went unanswered.12/9. I callled the companies main line a *************************** returened my call, During our conversation **** discovered that this was a cash job and not insurance and that the repairs should have been completed and possibly a Saturday appointntment to cinokete repairs. Nobody showed...I called **** on 12/27, 12/30, and I nebut and received a reply 1/3 I received a call from a ***** *** who I explained the situation and she would look in to the situation. Later that day she called me back saying that he repairs to the lumber was not part of the quote. I retold the story that they beams were exposed and plainly visible when *** quoted the job and he told me in writing that he was going to schedule nthem to came back out to complete the job 1/5 I cakked Bobbl *** againe and she told me that the company is discussing my situation.At this point it is clear to me that they are giving me the run around and have no intention to honor their contract. Our sales rep *** went out to ****************** home to complete an on-site inspection of his roof. While conducting his inspection our sales rep noticed damages to the roof caused by hail. After filing the claim ****************** insurance carrier did not approve a full roof replacement but ************** did hire Classic Roofing & Construction to complete some repairs to his patio roof due to ongoing leaks. ************** was quoted for the replacement of decking and rolled roofing on his current patio, nothing more. Upon completion of this project ************** did send a text to our sales rep *** asking why the rotted studs and fascia were not replaced. After reviewing the quote that was presented to ************** it was determined that the rotted studs and/or fascia was not quoted within his initial quote. ************** was presented with a cost to get the work done per his request which he did not agree to because he was under the impression that it was included in the original quote. The *** agreement signed by ************** states the following Limitation on Scope of Work: Replacement of deteriorated decking, roof jacks, ventilators, flashing, sheetrock, or other building materials, unless otherwise negotiated and written on the agreement, are not included, and will be charged as an extra on a time and material basis. Unfortunately, Classic Roofing & Construction is not able to move forward with additional work being requested by ************** at this time. The original quote presented to ************** is attached to this rebuttal.Customer response

I am rejecting this response because:
The statement from the company is false. I originally contacted the company because of the leak in my patio and the damage underneath which I months earlier took down the fascia Which exposed the damage to the section of decking and rotted beam. *** wanted to do an inspection of the entire roof stating that if insurance replaces the roof they would also replace the roofing on the patio and repair the damage beam.Insurance did not want to replace my roof So *** wrote the quote to replace the roof and decking and minor damage to my patio. I even had him upgrade the decking from 1/2"to 5/8" With the decking removed replacing this bema would have been a Minor repair.I believe that my text chain with *** proves that the beam repair was included in the quote ah is reply to the repair not being done was I will get them scheduled to come back to do the repair. NOT This was not quoted... Twice he told me that he would get them scheduled to compete the repairs.I can produce several people who can state that the rotted beam was plainly visible long before *** came to quote this job.
