I have employed a caretaker service to provide additional care for my debilitated, 90 year old mother while she heals from hip surgery. I am my mother's POA, but she is lucid and sometimes still handles affairs. I was informed by the caretaker company that my mother enacted a contract and had no reason to think otherwise. They knew that I would be the payer for all expenses, and I didn't dispute the rate. I handed over a deposit for a set amount of hours which I was informed would need to be refreshed. When the **** came it was nearly 3 times the agreed charges. I only asked for an explanation and I was threatened with immediate termination of services if I didn't pay. I was clear that I'd pay all overages, I just had questions. They continued to threaten to leave her unattended so I paid everything. At this point they still refused to explain anything to either me or my mother. Then proceeded to generate yet another invoice for an additional 6k, after I sent them 15k. And then I discover there was no agreement or contact AT ALL. They lied to me in writing. I have an extensive papertrail including lies and threats. To date I have paid over $15,000 and cannot either get any decipherable invoice, even a yes/no question answered, or any ability for my mother or I to limit overtime charges. And they additionally lied about made up conversations with my mother allegedly "approving" charges. She has always told them to only deal with me. I have extensive email documentation.

This gentleman, has been verbally abusive to me and his mother in front of my caregivers, they have witnessed his disregard for his mothers needs, and has sent written communications verbally abusing me calling me degrading names. We filed a harassment charges with APD since he texted me 15 times in 15 minutes demanding attention to speak with him as he had previously said he was not available after 8pm although started his persistent emails and texts at 8:02pm through-out the night continuing with emails.

All because he does not want to pay his ******* balance.  He claims we did  not provide an itemized **** which he already has in his possession and has paid ****** to date, for licensed care already on the same type of  invoices that are very detailed.

He has thrown tantrums in front of his mother; when his mother  and/or my caregivers every time we request a special Aid for his mom such as hospital bed (which he refused to buy at our insistence, and proper absorbent diapers and bed pads to be able to turn his mom since she had a broken wrist and was not able to assist us.)  He cut her hours when she was clearly having bleeding issues and HE had to contact the security guard at the facility to run upstairs and hand her a towel when his mother is not able to ambulate at this particular time.

He didnt respond to texts for 4-6 days the first week of 24 hour care during this while his mom requested the same caregiver.

His Mother  had already previously signed a contract agreeing to pay for overtime (if applicable) and made decisions on her own; which was very capable of doing until she fell and broke her hip as she told us she was afraid to ask him for more care. Initially signing a 2 day / week / 2 hours per visit contract.  In the contract it states you can request any changes of schedule giving us ample time to prepare ***** notice which they did since she was expected to be discharged from the hospital on one particular day then it turned into a later date; this due to oxygen issues etc. So he had no problems requesting more coverage but has a problem paying for his ****

They have been served with a 10 day notice to pay and then a Petition for Civil Suit.  In addition, he will be charged with Theft of Service through the District Attorneys Office
