      Hires Jacks Stone and Masonry for landscaping work on 11/22/22 for *****. ***** up front and ***** when finished. *********** the owner of the company started the work and after two weeks, he requested a 800 draw and said it would cost 500 more to finish. He confirmed that this was plenty to finish the work. Reluctantly I agreed as I was concerned that he would abandon the work. After two more weeks, he became consistently unresponsive to when he would finish the work. This week he responded and said to finish the work, he would need another 800 and needed another draw. I told him Im not comfortable with that until more progress was made. I told him I would give the additional 800 at the end of the project if he continued. He said ok but by the time I went back inside he left and is not responding to my calls or texts and has abandoned the work he started. I will be pursing legal actions.

      Good afternoon, my Name is ***************************, owner of Jacks Stone Masonry. ************** & myself had a agreement Proposal of approx. 189 sq. Ft. (Quoted ) Turns out to gave been approx. ******* big difference . When I approached him with issue of being much more to project then originally quoted we came to agreement of such number. When I asked him I needed to Revise Quote and Sign, which he mentioned he didnt have time to sign there and then , instead a hand shake was good, I did not think so. Deposit that was made was for materials which originally quoted was constructed.

      Materials and Labor was Performed and Remainder of materials stayed on site. 

      After Multiple Changes from height,  to excavation , with dept, 

      I felt it was a breech of Contract & I was Not  going to continue  without a signature .  I can understand a change or 2 -3 but when it comes to more materials & Labor thats when I bring issue to client,.

      I have never abandon a job in my entire time of being a good  ***** unless it was called by such a manner as this. 

      I have a 95% satisfaction rate as of Today . And plan on keeping it as such. Also continue  to perform my trade as it is fit for the Construction trade & Manufacture is called for.

                  My response: **** came out to my place 3 times, signed detailed description of the work, and he provided an estimate based on his visits and scope of the work.  I selected **** based on his estimate and assumed that his estimate was correct.
      When I approached him with issue of being much more to project then originally quoted we came to agreement of such number. When I asked him I needed to Revise Quote and Sign, which he mentioned he didn’t have time to sign there and then , instead a hand shake was good, I did not think so. Deposit that was made was for materials which originally quoted was constructed.
                  My response: That is absolutely not correct.  **** mentioned that the work was larger than he originally estimated.  I unfortunately believed him and agreed to a higher total for the project.  Additional $500.  In fact, I gave him 1/2 of the total cost of the project up front.  Per the contract, it was 1/2 up front and 1/2 at the end of the project.  Only after one week, he asked for an $800 draw and said the project would cost more.  After another 2-3 weeks, he asks for another draw and says the cost will increase yet again.  I asked him why as scope of the work never changed.  He just said, “you can see we need to do more work”.  My response was, I don’t understand as you provided the estimate and I never changed the scope of the work.  He asks me to sign an updated contract and I said I would need to review after my morning work.  He agreed.  I asked **** if he would work that day and he said he would.  When I came out 30 minutes later to discuss the updated contract, he was gone.  I texted him asking where he was and received no response.  Here is the exact text exchange including ****** incoherent messages.

You sign I’ll sign. We push forward. Or you draw it up

If you want to finish this project let me know. I will agree to pay the 800 additional if you are done by next Friday. I am not comfortable on another draw until more progress has been made. I have paid you $3,700, which is more than half of what we agreed on for the total contract and 1/2 of the work has not been done.

      Me: Happy to talk at 5pm but by your lack of communication have clearly indicated your abandonment of the project. You left without communicating with me. You took the stones you brought. I have tried multiple times to connect with you with no acknowledgment of your intent of return. We had three perfect weather days and you did not work and did not communicate on the why. So again, happy yo talk but at this point trust has been broken and I don’t know to move forward.

                  My response: **** completed 1 of 6 walls and left bunch of cut and uncut capstones in my home for someone else to take care of.  He did not bring materials to complete the work.  The capstones he brought were also not usable as they were cut incorrectly.
      After Multiple Changes from height,  to excavation , with dept, 
                  My response: There were zero changes.  All details were provided including elevation.  He signed the design document.
      I felt it was a breech of Contract & I was Not  going to continue  without a signature .  I can understand a change or 2 -3 but when it comes to more materials & Labor that’s when I bring issue to client,.
                  My response: The breach of contract was on the part of ****.  He not only abandoned the project, but continued to come back with ask for more money with zero changes to the scope.  Again, he provided all the estimates based on 3 visits to my home.  He signed all the design documents that outlined the scope of work.
      I have never abandon a job in my entire time of being a good  Mason unless it was called by such a manner as this. 
                  My response: That is also not true.  **** in fact mentioned that he abandoned another project.  I think this is ****** tag line but it is completely false.

                  My response: I trusted that 95% and maybe at one point **** was good at his trade but no longer.  He is untrustworthy        and completely lack professionalism.  If he has so much experience, how did he misquote by a factor of 400%?  **** took over $3600 of a $5,600 project and did 3/4 of one wall.  **** did not provide a refund for the work not complete nor did he offer any.  Please do not hire this **** and lose out on thousands of dollars.

      I hired him based on your accreditation and reviews I found on your website, yelp, ******* etc. What a mistake. He didn't show up the first day, and called me that late afternoon to let me know that he had a migraine. he did not show the second day, and tried to say that they went out but couldn't get in to the property (another lie, we have cameras onsite). So, he set the time for the third day, a Sunday - at 9 am. He arrived two hours early and was leaving when I arrived. He left an absolute mess behind. He did horrible work. I told him from the start it was white mortar with white sand. He used playground sand and regular mortar. I had to threaten him with bad reviews and a **** for repairs before he responded. Then he argued with me that there is no such thing as white sand. "Ma'am, you don't know what you are talking about. Sand is *****." I have about ten texts where he is telling me I am an idiot for thinking there is white sand. I finally sent him a link from a stone ***** site that talks about the hundreds of colors of sand available and what causes the different colors (minerals and chemicals in the water and ground), and showed him where he could buy it locally.He agreed to come repair it, but wanted me to bring him some of the original mortar because he isn't 'driving out there to prove' the match. I refused. He was paid $750 to do a tiny rebuild, and he is the expert, as he calls himself, so he should just bring what he needs to mix it onsite and make sure it matches. He did show up, and I have never felt so unsafe. He was literally shouting at *******, his helper, and screaming GD this and F that. Holy guacamole. ***** requires that I give him three chances to repair bad or substandard work, so I was forced into contacting him again when the mortar started falling out and cracking within a week. This guy has left me screaming voicemails, telling me to go *word redacted* myself, that I am a lying *word redacted*, and that I am a GD *word redacted*. What a scary man.

      Mrs.  *****, Hired me to come in & repair  an Island which causes for me to come in prep for clean up - as well as Stone & mortar  mortar matching . I went in took care of issue. Clean up complete . She then contacted me & mentioned if I could come out and Redo a few mortar joints reason being sand in mortar was different. She it was white sand which it was Not . I had to explain the mortar she proposed originally was NOT the color scheme as well. So a Good ***** that I am which never have a left a job unfinished as you can look at my Reviews not only on B.B.B. ******* Yelp , Angies Leads will tell you - we have a **** percent satisfaction rate. So I went out 1 hours away from were we are Located Central ****** -to Jonestown. And Repaired Mortar as we finished up asked here how it looks great she responded. And asked if I could touch up a few more things around stove Top . No problem. Did not seem to mind the mortar match then. I asked if it was to satisfactory, She paid me the Remainder in Full. 

         With this said, I see no reason for her Complaint. Theres Always 2 sides to a story.

      this guy is crazy  I did not say it was perfect, I told him I did not want to pay him the balance until we were sure it matched  he started throwing stuff and cursing at me  you should hear the messages he left me when I called him again because it did not match  

       

      you guys will end ** in a lawsuit if you keep recommending him. he is one super scary and dangerous man.
