      As a single mother and woman of color I trusted this place when I relocated to ***** since I had no family here. I went over all of the documents and within a month the car turned out to be a lemon. I had already paid for it and it is still appearing on my credit profile. I have filed a complaint with the **** and will seek litigation if I am unable to get this resolved because it is hindering myself and my son on moving into a better apartment. I am seeking this be removed from my credit profile.

      Thank you for the opportunity to assist you with resolving your concerns described in your dispute dated 4/12/2024 and received by us on 4/12/2024. We see that you have a potential concern regarding credit bureau reporting, but unfortunately there was not enough information provided so we can properly investigate and assist you.

      It is our goal that every customer interaction with ********************** reflects a positive experience. The complaint requests that

      1. SAMEDAY AUTO must update its tradeline to paid as agreed never late on my consumer report immediately and provide confirmation of this action within 30 days.
       2.SAMEDAY AUTO must launch an investigation into my dispute as mandated by law and provide the results within the stipulated 30-day period.
       3. SAMEDAY AUTO must cease all debt collection activities with prejudice.

      but doesnt state what exactly is in dispute.  For us to investigate a dispute, you must provide specific information and an explanation for the basis of the dispute. Your dispute suggests that there may be a dispute to the accuracy of the information we reported but doesnt provide any detail or additional information.

      Per the requirements in Appendix A to Furnisher Rule Part ***** paragraph (d), a furnisher must conduct a reasonable investigation of a direct dispute if the dispute notice includes:

      (1) Sufficient information to identify the account or other relationship that is in dispute, such as an account number and the name, address, and telephone number of the consumer, if applicable.
      (2) The specific information that the consumer is disputing and an explanation of the basis for the dispute; and
      (3) All supporting documentation or other information reasonably required by the furnisher to substantiate the basis of the dispute. This documentation may include, for example: a copy of the relevant portion of the consumer report that contains the allegedly inaccurate information; a police report; a fraud or identity theft affidavit; a court order; or account statements.
      In addition, paragraph (f) states:
      (f) Frivolous or irrelevant disputes. (1) A furnisher is not required to investigate a direct dispute if the furnisher has reasonably determined that the dispute is frivolous or irrelevant. A dispute qualifies as frivolous or irrelevant if:
      (i) The consumer did not provide sufficient information to investigate the disputed information as required by paragraph (d) of this section.

      Beginning September 26 to present Claims that we dod not have insurance on our vehicle Multiple phone calls from Same day Auto We have spoken to Several employees and sent in proof multiple times to multiple people as well as the email provided to send proof to as well as my insurance agents sending in the proof. I was told it would be taken care of and they would remove the charges for not having insurance. Made payment in October only to find out now that it was never taken care of so I am showing as partial payment. I received this call 5 days before by **** is due and am being told it may take up to 15 days to verify my insurance. This company lacks in communication and lacks in leaving notes about transactions or agreements made, not to mention staff cuts you off when speaking, most are rude, some have hung up on us and others try to cut the conversations short.

      I am requesting that Same Day Auto Finance remove the account ****** from my credit report. I have had many problems with the accuracy of your reporting. Even still, I did not pursue legal action although there was gross misconduct, negligence, and many **** violations. You also failed to respond to my dispute letter sent 2 months ago. I will attach the letter, which is dated, and time stamped for your reference. In 2019 you sold me a faulty car. The car I purchased stopped working before I could even make my first payment and I have record of this email to you as well as the **** report that was filed in September 2019. I reached out to your company several times and you eventually claimed that it was past your warranty period which was not true. Lastly, the balance reporting is inaccurate. Not only am I asking for the removal of this account due to inaccurate reporting, but I am also demanding this account be removed to avoid a lawsuit against your company for misleading a buyer into buying a damaged car and failing to carry out repairs covered under warranty. You also failed to refund the purchase and continued to ************ account to the credit reporting agencies knowing that the car was faulty. I have every reason to believe that your company engaged in some type of auto fraud. I know that each violation under the **** is worth up to $1,000 and I will be suing for the maximum per violation if this account is not removed from my account.

      I am rejecting this response because: I submitted a complaint to which your company stated that you could not verify the account with the information provided. According to the ***** this is a violation and grounds for removal. Your company also asked to provide the account listed on my credit report. I have attached the account in question. Your company should have record of all accounts being furnished to the CRA's. You are reporting inaccurate information, and I am requesting the removal of this account from my credit report immediately. The location of the specific branch is ****** **. However, if I have to take this to small claims court, I will be suing the company as a whole.

      SameDay Auto is not a dealership, but an indirect finance company.  As such, SameDay is governed by various regulations covering consumer disputes, such as the Fair Credit Reporting Act.

      Per the requirements in Appendix A to Furnisher Rule Part ***** paragraph (d), a furnisher (us) must conduct a reasonable investigation of a direct dispute if the dispute notice includes:

      On Feb 23 I logged in to make a payment on our truck , it was then that I noticed our vehicle payment went from **** to over ****. I contacted the company to find out what the issue was. They stated they had added insurance to our truck because we didnt have any. At that time I assured them Ive had insurance on our vehicle and it never lapsed.we switched insurance companies back in October of last year and they were never notified. Understandably they did what they thought they needed to, so I went ahead that same day and sent them over our insurance documents to prove our current insurance and that we have always had insurance on it. They assured me it would be corrected and a credit would be issued to our account for the insurance mess up. I have called and emailed insurance info numerous times since then and just recently had our insurance company send the info over to them and weeks later this is still not corrected. Our next payment is due on the 30th of this month and I will be making our regular payment again as usual but want the insurance side of it and the credit on my account. I even asked to speak to a manager or insurance person at same day auto and of course as usual they werent available. I just want an adjustment to our account, I was understanding to begin with but weeks later I keep hearing the same thing and nothing is done.

      I was seeking to change the payment date for the my vehicle that I finance with them . I initially requested the date change on 10/29/22 and spoke with a representative named ***** that said that I was approved for the date change request, and that he was sending over the paperwork for me to sign, I never received the paperwork. On 11/09/22 I received a called stating that my payment means due, I was confused because I thought my payment date was changed, after I made the payment I again requested a due date change and was again advised that I was approved and that the paperwork would be sent over, again I never received the paperwork. I have now requested another due date change on 12/30/22 and was told to call back on 01/03/22 to check the status, this has not happened before. Im in need of a cure for this ongoing issue please.Thank you

      Back in April 2022 I had ***** was told that I was going to get payment deferred, which I filled out form and sent back to the company, they went ahead and reported me to the credit agency and my credit score went down 65+ points, I have emailed no response at all. In addition I have never gotten a coupon book for my payments, or ever gotten anything that tells me my interest rate, what I owe nothing at all. They are good in emailing you calling you and harassing for payment but when the consumer needs anything they go silent. I have requested a coupon book numerous time and also to have my credit updated as I want to refinance my car have asked for a 10 day payoff to no avail either this is ridiculous. I am very unhappy
