      I appreciate your feedback, however wanted to address a few things mentioned in your review. In the original estimate there were two prices mentioned, one being with the ***** included that was higher and you said you wanted to pay the lower price, which ultimately this is what was agreed on. Although the lower price is what you agreed to after expressing your desire for the ***** to be taken care of at no additional cost, we did agree to come back, however the time frame was not guaranteed. Just a few days later instead of calling us to inquire about our time frame you wrote several reviews attacking our employees character and inferring that karma will be out to get them. Im sure most agree, this type of slander toward our employees will not be tolerated, especially when we were going out of our way to work in a price that you wanted. 

       

      As our past reviews show since this is the only negative review we have ever received, we pride ourselves in working with the utmost integrity and always try and do everything in our power to ensure customer satisfaction. We still want to come to a resolution with you, and would be happy to speak to you about this, we just will not tolerate bashing our employees in the process of coming to a resolution.

      If you were so interested in coming to a "resolution", why did you wait over a month to respond? in an email from the bbb moderator dated nov 24 he wrote " If we are not able to assist in achieving resolution for your complaint via our process, you might try filing in small claims court or seeking legal advice for further resolution.".

       

      Taking his advice, I already have spoken to my lawyer. First, he wants you to know that your accusation of slander does not stand because slander is a spoken statement, the word you are looking for is Libel which is a written statement, but that won't work either because it has to be a false statement. I only told the truth. I did not attack your employees.

       

      When ************************* promised to come the next day, Saturday, didn't show up, I called you and you acted surprised that he hadn't already been there, but you would contact him. Still, no show.

      After that you wouldn't answer my calls anymore. After 4 days, I posted on your ******** page asking when you were going to finish the job and the post was removed and I was blocked. Shortly after, I received a msg from ************************* inviting me to reply to him, however he immediately blocked me after sending his message, preventing me from any further discussion.

       

      This is evident in the uploaded image marked exhibit 3.

       

      Is it because I told you the day prior, that I was going to pay you cash, the reason that you "forgot" to bring your ***** grinder and your receipt book?

       

      I guess you didn't notice that I have an 8-channel surveillance system surrounding my property. I have recorded video and ********clear audio of you, your crew and the whole operation. Including the day before when we made the agreement and shook hands. Maybe your memory will be refreshed when we watch the playback in court.

       

      As I don't have the time or expertise to capture and upload video clippings on this forum, I took photos of my system playback. You can see exhibits 1 and 2 are from Camera One in the front of my house. It shows your arrival, and me counting out the cash at the end and handing it to you. Everything in between , minute by minute, is all on video and audio from different perspectives.

       

      At this point, I want to add Gross destruction of property to my complaint. I didn't realize until the other night, while I was reviewing Camera Two footage, how my favorite plant got destroyed. You can clearly hear us discussing about the expensive plants in my garden and you all promised to be careful.

      The video shows ********************* III taking a break, walking all the way to the east side of the garden, far away from the tree and where the tree branches were falling, trampling my plants instead of walking on the stepping stones, then pulled out his phone, sat down on more flowers, leaned against the chain link fence breaking my three year old Alamo vine.

       

      It's all on my DVR, about the size of a laptop, which I will take with a monitor to the district court in **********, where you, me and Judge ****** will all watch together.

       

      My Lawyer won't have to go to court with me. I can do small claims on my own, if you decide to bring a lawyer make sure he knows about this:

       

      The ***** Deceptive Trade Practices Act (DTPA) (Tex. Bus. & Comm. Code ***** *****) provides that a plaintiff can recover additional damages of up to three times the amount of economic damages if the defendant acted knowingly or intentionally and three times the mental anguish damages if the defendant acted intentionally.  Tex. Bus. & Comm. Code 17.50(b)(1).

       

      Exhibit 4 shows the mess you left me to clean up and the gigantic ***** in the middle of the yard.

       

      Even though I have overwhelming evidence and will most likely win this case, I really don't want to get up early and spend a good part of a day in ********** so I will make this proposal:

       

      I will accept a partial refund of $100 plus return the $15 tip and I will consider the case closed.

       

      upon receipt of this compensation, I will agree that the BBB complaint is resolved.

       

      If not, I'll arrange to have the sheriff serve you the papers, your choice, I'll give you a week.

      Although we have never experienced this type of miscommunication, I understand that your perception is reality and in order to make this right with you we will be glad to give the $115 total refund. How can we provide this to you? We can mail a money order or send through any payment apps such as Cashapp, Venmo, etc. Please let me know.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and wish to answer with this response.

      The preferred method of payment would be cash in person, the same way I paid you. I live 10 minutes from the Post Office.

      But an alternative method would be mail a Postal Money Order as you suggested. Mailed from ************* it will reach me in one day.

      Either way, because of the disrespectful manner in which you made myself and the BBB mediator wait until the very  last possible moment of the arbitration, I will expect payment within a few days.
