Previously I lived in a apartment complex and the lease Manager did not like me she intentionally placed this incorrect debt on me on purpose knowing I did not owe any amount. I never paid rent while living here it was paid through a program for women who deal with domestic violence and the program paid the entire lease and deposit. all information is wrong and I do not owe this debt. I went to the office myself because it recently showed up on my credit report and is stopping me from being accepted in housing, The manager is still at that location and gave me RS Clark information and said she could not assist or give me my original lease I found it myself and have since informed the collection agency. I will be taking legal action and soon because I reported this over 30 days and it has yet to be updated or processedBusiness response

RS Clark and Associates has repeatedly violated FCRA by calling me repeatedly after I told them to stop calling me. They also failed to notify me about reporting derogatory info. to Equifax, Experian, and Transunion In section 603(p) 15 U.S.C. ss 168s-2(a)(7)(A)(I); The notice required under subparagraph (A) shall be provided to the customer prior to, or no later than 30 days after my info., furnishing the negative derogatory information to a consumer reporting agency described in section 603 (p), 15 U.S.C. ss 1681s-2(a)(7)(B)(I). They also violated commercial law under UCC ***** that all notices were timely and properly given by dated certified mail receipt. They were not met. I asked for documentation & received no response. Also, CCS COLLECTIONS" failed to give me my five days prior to placing this derogatory item on all of my credit reports, per Section 809, which is $1000 per violation and allows treble damages.Under 809. Validations of date under Section 807(1)CREDIT COLLECTION SERVICES. Their officers failed to send me my initial communication before placing this alleged derogatory status on my credit reports further violating the *** Codes and FDCPA and FCRA. I understand that according to the Fair Credit Reporting Act, failing to provide this notice can result in a penalty up to $2500 and can be enforced by the and that my state attorney general can also enforce this with a $1000 penalty as well.I attached a copy of the law and the actual document from the federal reserve CCS COLLECTIONSis held liable as well for defamation and in the a creditor is who collects their on debt is considered a debt collector under FDCPA. v. Heard 980 S.W.2d693(***.App-1989 reh. den.) citing 936 S.W.2d 654(.App) I will follow up with the **** and AG's office should these derogatory tradelines not get removed and the harassment does not stop.Customer response

Hello. I reviewed my Consumer Reports and noticed that there were an inaccurate accounts on my credit report. ACCOUNT NAME: RS ********************** AND ASSOCIATE.ACCT# ***************.ACCOUNT NAME: RS ********************** AND ASSOCIATE.ACCT# ******************************************* play a crucial role in accurately reporting consumer information. I contacted all credit bureaus to request an investigation and removal of an inaccurate account they are reporting illegally.Specifically, I asked for the original application with my signature, but they have failed to provide this evidence. Also, I contacted the *** Clark and Associate" directly and requested "validation" - evidence bearing my signature, showing that I have (or ever had) some contractual obligation to pay them.They received my email on June 7th (I will attach proof), but I haven't received any requested evidences from them within a month. This is a violation of the Fair Credit Reporting Act, and these disputed items may not appear on my credit report if they can't be verified by any evidence or proof.Thank you!Business response

I have submitted my dispute to RS Clarks and Associates for they are a collection and there is an account with them that I am not aware of. I have never signed or applied for services with them nor Appliance Warehouse. They purchased a debt that was not verifiable and I have no connection with. I have already forwarded over disputes to their office and they should be in processing to have this account deleted.Business response

A few months ago I noticed a collection on my credit report for an account opened in May of 2023. The collection agency is R.S. Clark and Associates and the original creditor is a previous apartment complex that I moved out of in 2021. I paid rent on time every month and paid all fees before moving out. In 2021, I had to move apartments in the complex due to the Texas winter storm that caused damage to a number of their units. My wife and I were looking for a house, so we were on a month-to-month lease and did not want to sign a new lease. The complex transferred us to a different unit and allowed us to remain on a month-to-month lease under their 6-month lease rate due to our unit being damaged by the storm. We moved out of that unit in May 2021 and provided all information needed to move out and paid all rent and utilities needed. I was never informed of any other fees or payments and have received zero communication about the collection or debt. I have made an official complaint with the **** and R.S. Clark and Associates is not listed as receiving complaints. I have never received paperwork or information regarding this debt and it should be removed from my credit report.Business response
