This incident happened on the evening of November 24, 2021 during the seasons first snow-fall. I was driving on W *** *** near Golden when I struck a large pile of salt sitting in the middle of my lane. This resulted in front end damage to my car. About a mile ahead of the accident, I saw two large snow and ice mitigation CDOT trucks. The same night, I reported the incident to the Golden Police Department (incident # XXXXXXXX-XXXXXXX). Being the first snow of the season, one of the CDOT trucks must have been filled too high and dropped some on the road. Because CDOT is state run, I filed a claim with the Colorado Attorney General. The Attorney General forwarded my claim to an operation called Choice TPA, LLC. Choice TPA conducted an investigation and denied my claim. The investigation confirmed that CDOT trucks were maintaining that stretch of road the same night but said that Golden and Jefferson county also use those roads and they may have been responsible for the salt pile. They also refused to do any investigation matching the material stuck in my car's grill to the material used by CDOT for ice mitigation. Then I did an investigation of my own. Both Golden and Jefferson County told me they do not maintain W *** Ave, that is exclusively CDOT's responsibility. And neither sent trucks out that night. I also learned that the material in the grill of my car is the exact same that CDOT uses for ice mitigation, basically brown salt called Ice Slicer. Based on this information, my Choice TPA agent told me they'd reopen their investigation. That was in May 2022. I have reached out to them since, always with the response that they have not completed their investigation. After 5 months of waiting, I suspect they are now just ignoring me. My claims agent is ***** ******** and her contact phone is XXX-XXX-XXXX. My claim number with Choice TPA is LXXXXXX.

      Business response

Business Response /* (1000, 10, 2022/11/21) */ This event was forwarded to the State of Colorado Attorney General's office for review and monitoring. ********* ******** and ***** ***** are the AG's reviewing and handling this claim. Consumer Response /* (3000, 12, 2022/11/22) */ (The consumer indicated he/she DID NOT accept the response from the business.) If I could, I'd give this a response a maybe depending on the outcome. Why a NO? The business has had plenty of time to investigate my claim. Instead they ignored me (and from the looks of it the BBBs first notice) for months. Now they have passed my claim onto another entity. Why not pass this claim on sooner? I am encouraged that they at least did something. I am certain they would have continued to ignore me without the prompting of the BBB. Business Response /* (4000, 14, 2022/11/28) */ This was not just now sent to the AG's office. This has been with them the entire time. We are simply a 3rd party to the state that handles some claims. This claim is being reviewed by the Attorney General and we have no control over their office or their timeline. You are complaining to the wrong company. Consumer Response /* (4200, 16, 2022/11/29) */ (The consumer indicated he/she DID NOT accept the response from the business.) The correspondence I received from Choice TPA clearly states that they were handling my claim on behalf of the Colorado AG. Choice TPA told me that their risk management team was handling the investigation. Never once did they tell me the investigation in the hands of the AGs office. Now they are changing their story. If the investigation had been with the AGs office the entire time, why not communicate that in the first place? Why not ask them to complete the investigation? Why just ignore me?
