      In April of 2023 I hired Hammer and Nail to level my foundation along with several other jobs. Though I realized there was chance I would still not be completely leveled, when they were done, the home was not leveled and the foundation was in worse condition than it was before. What made it worse is that the completely took down the back part of my house so they were starting from ground up and even the new side is not leveled. After leaving gaping holes in the foundation among other issues (HVAC disconnected and left laying in pieces, floor awkwardly held up by thin wooden pieces unevenly placed between columns and not secure, no vents where there were before, trash all throughout the crawl space) and and me complaining they came back and did little things to cover up so I couldnt see the issues that still remained (eg place a piece of wood over a missing cinder block and close off the outside gaps without fixing problems inside). They would come back and I would look and have no idea what they had done. There was no issue with not having material because anything they needed I would go and get or order for them to pick up. I ended up paying because I didnt want to seem to keep making excuses not to pay when the job should have been done weeks before but I they never resolved the issues. It was not complicated or hard to see the problem. I would send pictures and they would seem to clearly understand the issues. It seems they were just over the job. Fast forward a couple a months and the house has to go on the market and of course the major concern is foundation. I am not one to go into litigation but I thought at least it should be made known. I spent a lot of money with this company and in hindsight, I feel they really took advantage of me being a first time investor. Very disappointed.

      I understand that the house doesn't have a level floor, like a new house would, let's be honest it is a house built in the 1800s.When we first got hire by ***************** to install new siding and roof, then the project got bigger.

      When ***************** first approached me about the flooring issue we discussed applying quick set thin level through out the house, but he wanted it a more economical way to fix the issue. We advised him that the foundation had a lot of problems the piers were falling apart and that most of them need it to be rebuilt. The price for that and replacing the damage floor joist was $19,500

      To which he said it was to much, we ended up agreeing on a $11,000 to just replacing the floor joist and leveling the floor as much as possible.

      Now he is coming back saying that the work was not properly done, 

      I will give him back $3,500 just to let him know that hammer & **** does not take advantage of people, we do what people asked us to do. Look at all the reviews we have we don't have a single complain all praises.

      The business said they were going to refund me $3,500. I have not received that refund. I would like to know when it is going to be issued.

      The last email I received from BBB said the this case was closed, because the litigator didn't respond.

      Never, nobody has contacted me for anything else after that, until now.

      After talking to my lawyer he advised me not to pay because ***************** has no case.

      We offered to fixed the foundation and he declined, like I said before and I have my two uncles as witnesses that he didn't want to repair the foundation, ***************** paid Hammer & Nail Home Improvement LLC to level the house as best as possible.

      Better Business Bureau:

      In reference to complaint ID ********, ****************** and Nail originally agreed to refund me $3,500 and now is no longer offering a resolution. They claim they offered to fix the foundation which is not true. There has been no contact with them since the filing. The original offer and acceptance of the offer is all recorded here yet he speaks as if he had no idea. They admittedly spoke with an attorney after the resolution and have now changed their tune. This is likely because they were not truthful to the attorney either. 

      I would be satisfied with the original agreement of $3,500.

      See attached. Of $11,000, $9,500 was for the floor, adjusting plumbing and small roof in back. This was purely for labor. The other $1,500 was for take down the wall between kitchen and living room.
