      Case 20660065
      To whom it may concern

This complaint is inaccurate. The gentleman in question brought his vehicle to our store weeks after purchasing with a suspension issue most likely caused by aggressive driving. In watching him speed over our speedbumps without braking and damaging our building awnings with his other vehicle, it is clear that his driving style is indifferent to the potential for damage to his own vehicles or the property of others and most likely the cause of his post-sale suspension part failure. While attempting to explain this to him while his car was on our lift, and before we could explore solutions that could be beneficial to him, he became belligerent, agitated, aggressive, and physically demonstrative. At this point we terminated our relationship and asked him to leave our facility.  He initially refused and attempted to physically block the path of management attempting to gain access to the building.  We were forced to invoke trespass law to encourage ************** to leave the facility on his own accord versus being forcibly removed by law enforcement professionals.  We do not tolerate abuse, intimidation, or attempted bullying of our staff under any circumstances. We will always politely end a relationship with a customer in order to preserve the mental, emotional, and physical safety of our staff.  ************** has also demonstrated a clear tendency to misrepresent key details in an attempt to gain favorable action.  To this point, we are in a liability dispute with him due to $5000 in physical damages caused by him on our property while he was carelessly operating an uninsured vehicle.  We are not interested in any further business dealings with ************** other than to collect thousands in damages caused by him to our property while he was operating an uninsured vehicle.

      Respectfully,

      ***** Reynolds, Jr.

      Customer response

      10/13/2023

      Better Business Bureau:

I have reviewed the offer and/or response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

I hardly know how to respond to this highly unprofessional diatribe.

The awning is a completely separate issue. Yes, I did brush the awning while driving a 16-foot box truck.  I am working to pay the damage. The single estimate sent me, and I expect a couple more, for the damage came in at $3411, not $5000.
The rest of Mr. ********************** response is worthy of a seven-year old, but I would expect a more cohesive writing from one. His claims about my driving are totally unfounded. Unlike him, I do not stoop to personal attack.
As to his invoking trespass, the state trooper that I spoke with about the faulty inspection sticker told me that the law simply does not back him on this. Also, if Mr. ********************** is so polite, how did the conversation come to that stage? The man gives himself the lie when he writes of his politeness. I can find no further civil reply.
If I had known that I should have let the state police inspect the defective suspension before doing the repair, I would have. The trooper told me that all he could do at this point is to warn the service department. He would have liked to have been able to suspend Mr. ********* (the inspector) inspection abilities again. He agreed that there was no way that the Foresters suspension could be so damaged within three weeks of an inspection, even if I had taken my all-wheel drive utility vehicle rock climbing every day. He also agrees that underinflated tires are a dealers trick used to sell a defective vehicle. Sadly, I did not record this troopers name, but he is sole person with responsibility over the inspections performed at ********************** Subaru.

Mr. ********************** would like us to believe that he is a mature, honest businessman. This is hardly the case. His written response to my complaint demonstrates that.
I stand by my complaint as submitted and am completely unsatisfied. ********************** Subaru has not met its obligations. I would advise anyone to not do business with this dishonest company.  with this resolution.]

      Regards,

      *********************
