On February 27, 2024 I entered into a contract to purchase a home in ********, Virginia. At that time I submitted ernest money in the amount of $1500 to the Lilly Title and Settlement, LLC. The contract stated that I had 45 days to get a contract on my home in ***** ********. After I got a contract on my home I had 75 days to go to settlement. After the 45 days, I didn’t get a contract on my home so the contract for the home in Virginia was cancelled. The ernest money was returned to me in the amount of $1250. The Lilly Title and Settlement company withheld $250 for the title search. There was no specific date for settlement. I feel that this company did the title search prematurely. I intended to pay cash for the home in Virginia. I have excellent credit rating and the company gave me the reason that “people want work done and don’t want to pay for it.” I had full intention to pay for the title search at the time of settlement. My husband and I have purchased 7 homes in the past 44 years and have always paid for the title search at time of settlement. I am now a senior citizen, a widow and I care for my disabled son and cannot afford to give this company $250 and get nothing in return. I would appreciate any assistance you can provide to help me get the remaining ernest money back. Thank you in advance for any assistance.Business response

I am unsure as to why she made the complaint. She emailed me yesterday and said that she wanted a full refund. I responded that we proceeded with title work that we received a fully ratified contract and her EMD deposit.I never said I wasn't going to send the funds back to her.Customer response

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution would be satisfactory to me. I will wait for the business to perform this action and, if it does, will consider this complaint resolved. Regards, **** *******
