I am board president of a small non profit organization (***********************, *************************) We contacted *** ******, owner/operator of Divine Swine, a BBQ food truck to cater a fundraiser event in May 2023. At that time, we felt he could meet our needs, paid him a check for $2000.00 deposit which he cashed on May 5, 2023. He was supposed to contact us with more details, and after almost three weeks of not hearing from him, we started reaching out to him. After multiple calls, emails, texts with no response, we realized we could not use him for our most important fundraising event of the year. We had also heard back from multiple sources that he was not dependable and was flakey. Finally, through a roundabout way of an acquaintance of his reaching out to him over ******** messenger, and instagram messenger, he text messaged a board member on July 8, 2023. I then called him and informed him we were cancelling our contract and wanted to get a refund of our $2000.00 deposit. He indicated verbally he would do so after I sent him an email stating we wanted a refund. I sent him that email on July 10, 2023 stating our reasons for cancelling the contract. This began our long journey of him making a few payments promising to pay back on a monthly basis, but then never following up, me emailing, texting, calling him and he making a small payment, and promising to pay again monthly, but then disappearing. He has been advised multiple times that he can make small payments, monthly or weekly, and had he done so this would have been paid off a long time ago. He always promises to make a payment, and most recently asked for a record of his payments to see how much left he owes, which i provided him. At this point he owes us $1050.00. His last payment was in May 2024. I advised him that i would file a complaint with BBB, prior to going to small claims court if necessary . As i said, we are a small nonprofit and this amount of money has a real impact.
