******, we completely understand your frustrations. Timeshare companies are notorious for using predatory and dishonest practices to manipulate consumers into opening an account, and then they often do not honor their end of the agreement with the services they claimed would be available to their members. Escaping the contracts can be a nightmare and even when the timeshare is canceled and account is closed the timeshare company continues to report the negative history and damage the credit scores.
Unfortunately, even in cases where a creditor used shady practices and/or breached their end of the agreement the fact remains that the account was legally yours between the date opened and date closed. The credit bureaus are not interested in negative consumer experiences with a creditor only with the details of the account (date opened, monthly payment history, date closed, final status, and current balance).
As discussed previously, the Federal reporting laws per the Fair Credit Reporting Act (****) dictate that a negative account is to remain on the credit report for seven years from the date of last activity (date of last payment ever made toward it). Being closed and even having no further amount reporting as owed are not reasons for an account to be removed from the credit history report. There is no law to force the removal sooner than the seven-year statute of limitations for reporting, however, the **** does allow consumers to dispute any information on their credit file. If not verified by the reporting source, then the bureau assumes the information is incorrect and deletes whatever was disputed. If, however, the creditor verifies the information then it remains.
This is why The Credit Guru never guarantees a specific item will definitely be removed. We do not use false promises to try and boost our client base like some companies do. We pride ourselves on being transparent about the process and about how difficult removal of certain types of accounts can be. We are here because, as you know,fighting these timeshare companies is a time consuming and frustrating process. Without disputing the history with the credit bureaus, it does continue to damage the credit for the full seven years until it falls off the report naturally.
We may not be able to predict the outcome of a dispute or guarantee a specific deletion, but our services ensure that each month the negative history is challenged and thus each month it has the chance to be removed rather than leave it to sit on the credit for seven years until it falls off on its own.
As we discussed previously, the letters you receive from the bureaus are sent at random to consumers who dispute their credit by mail even consumers who do so on their own with no third-party assistance. It is a standard response, and the reason you received so many of these letters is because we sent so many disputes to the bureaus on your behalf. Since the **** allows the bureaus thirty days to complete each investigation, we ensure that every month as the last investigation is completing a new one is initiated. This ensures the most possible opportunities for a deletion to occur.
We always leave the option to proceed or to cancel services up to our clients. The special rate which exactly meets our operating expenses with no profit margin was offered to you because we feel so strongly about doing everything possible within the laws to get negative timeshare history cleared off the reports. (Unfortunately, we are not a non-profit and thus cannot afford to provide credit repair to consumers without meeting operating expenses.)
