Met with and agreed on a two week project to put in a concrete patio in our backyard. Project started June 7th, this consisted of ripping out lawn and a few bushes. After that, ***** the owner was sick which delayed the project. Finally, after numerous messages concrete was laid on July 8th. ***** came back a week later while we were on vacation to remove wood from sides and adjust our fence door as it was getting caught on concrete, and put in a drain system which he made us pay for upfront ($1,500). When we came back from trip wood was removed, instead of adjusting the fence door as agreed ******************* part of the concrete instead. (looks terrible) the drain system was not done at this time. Ever since then we have emailed/texted/called ***** and he has been completely unresponsive. Additionally the concrete patio is cracking a lot- I understand some cracking is normal but there are some cracks that are expanding now that are concerning. As of right now ***** refuses to answer any of my messages all I would like is to get my $1500 back since the drain was never completed. I rather ***** not fulfill that part of the work as honestly I am not comfortable with having him back at my home. He has been very aggressive and not pleasant to work with. This client has exceedingly asked for extra work from start to end. We, Able Concrete, have done over **** in extra work not charged. He asks the same questions over and over and over again. The project was completed as estimated and accepted. ***** just wants more and more done for no charge and cannot accept the fact that the project is completed. The cracking in the patio are at the control joints which are placed FOR cracking. They have performed as expected. ***** has been a nightmare to deal with, texting late at night and all weekend long.Customer response

I am rejecting this response because:***** and Able Concrete should not be in business and are an absolute nightmare to work with. He argues everything and wants to do as minimal as possible, while charging more. He provides a quote, then keeps adding new costs to it after starting the work. The quote was for 14.5K + Taxes. In fact, he did not provide the landing to the side yard that was agreed to in the beginning, nor did he provide the drain/rock that was agreed to for 1.5K (shown in the quote).
After he tears up the yard, does most of the prep work, he asks for another 2K for the same work and $390 more for some mulch he should have already seen as he did the estimate. He also charged me an extra $1K for concrete without any notice, as clearly he doesnt know how to estimate this properly so charges more. I paid 3.5K more than he estimated, which is ridiculous. He did not provide any extra work for 3.5K not paidthe quote and payments speak to this directly, so this is an out right lie. I paid the full quote + the 3.5K he over changed for, and am a model customer. He even had the audacity to ask me to pay his day labors in cash for 1.5K on 7/8 as he forgot his walletwho does that?
There are a few issues here, so lets clarify. (1) ***** did not provide any services not paid for and he knows this (2) ***** is disrespectful and makes a mess of everything, ruining my neighbors front yard which I had to pay to fix, and even breaking my concrete by my fence gate that he just installed to take a short cut to make sure it opened (3) I paid 1.5K for drain and rock that were not provided (4) The concrete is already cracking everywhere, so the structural integrity of it is in serious question and now I have to have an engineering evaluation to understand the damage (By the way, ***** has know idea on the cracks as never inspected them, just fully ghosted us after messaging himnever inspected the work after repeated requests since 7/8). The cracks are not just in the joints, but on the surface as well (every single joint has cracks down to the ground, plus at least 2 major surface cracks currently)
Right now I want to take care of the obvious, which is the 1.5K+Taxes for the services not provided for the drain/rock. I know my rights. I expect a check in the mail for this amount to close this drain/rock issue out. Honestly, Im shocked that this is even being debated as he has promised to stop by and complete this work every week for the last 4 weeks (have text messages to prove it), plus the first promise to complete this work on 7/11. See attached picture where there should be a drain and rock...not there is it?
As for the cracking concrete, time will tell on if this holds up and I will have to have an engineer take a look to evaluate it.To make matters worse, he is wasting my time, making me go through this process as opposed to just owning up on the work not completed with a refund. No customer should be subject to this treatment.

Again, ***** is a nightmare to deal with. As indicated by his continuous complaints. He wanted more work and more work requires more money. He would not listen to our instructions on anything. He knew the landscaping would be slightly damaged and then demanded that we fix areas that were not in our contract. His job was written clearly in the contract he provided yet every day he wanted more and more and more. He called at all hours of the day, sends 20 messages about we had just talked about and is overall just a very annoying person to work with. We had to constantly refer to the contract to get through the project. ********** he would waste our time while on the job asking the same exact questions we had already talked about and texted about. He has no respect for anyone and as indicated, he continues to be a nightmare. The job was completed per the written contract. We owe him nothing.Customer response

*************** me 2.7K for the Drain/Rock and Side Yard Landing not provided. This was in the contract, paid for in full, but not provided. I have all the evidence to support *****'s commitment to provide this work.
