Unsolicited contact via text messages asking if I own a piece of property and wanting to buy it from me. This has been happening constantly, no matter how many times I block the number, the text and call from another number. I asked how they got my contact information and was told they use a service to find owners information. I just want them to stop contacting me unsolicited and to not contact me.Business response

I am rejecting this response because: I have asked to not be contacted several times! But they use different phone numbers and either call or text from them! Contacting people unsolicited asking if they want to sell their house to me is unprofessional and shows you the lack of respect they have for people.Using a "third" party company to search for "customers" and then contacting them.

I am filing this complaint against Foursquare Real Estate Company regarding the sale of my property located in ********, ** in December 2022.I live in ********** and purchased the property (a condo) through a mortgage loan in my name only. There are two title holders myself and my son-in-law, who lived in this condo unit.On Nov 1, 2022, Foursquare entered into a sales contract with my son-in-law on the assumption that he was the only title holder. About a week later they realized their mistake and that I was also a title holder, and then contacted me to sign-on to the illegal contract. I did not agree with the extremely low sales price of $225, 000, and was not going to approve the sale. So to sweeten the pot the agent *********************************, offered me $1500 to sign-on to the contract, which he put in writing through a text message. After some thought and reluctance I agreed to sign the deal.The sale was completed on Dec 2, 2022 and to date I have not been paid the promised $1500 after a number of commitments and follow-**** Listed below are in chronological order the activities pertaining to my complaint:11/01/22 Initial contract started.11/06/22 Notified Foursquare contract was illegal without my ************/09/22 Got text message offering me $1500.11/10/22 I signed contract at $225K.11/29/22 Received settlement estimate, $1500 not shown. 1 - Response: Our point of contact for the purchase of this property was ******* son-in-law ***. ******* daughter, and **** wife, had recently passed, and *** moved forward with signing a legal real estate purchase and sale agreement.
Since we always hire a professional title company and closing attorney to process our real estate transactions, we did learn that ****** was also on title and needed to sign to legally proceed with the purchase of the property. Thats why these professional companies exist, to protect each party. The term that Ramesh meant to use is invalid. Without his signature on the purchase agreement, the contract was invalid, not illegal, as we were always within the usual legal framework of offering on a property and entering into a purchase agreement.
2 - Quote: I did not agree with the extremely low sales price of $225, 000, and was not going to approve the sale. So to sweeten the pot the agent *********************************, offered me $1500 to sign-on to the contract, which he put in writing through a text message. After some thought and reluctance I agreed to sign the deal.
2 - Response: At first, you did not agree to the price of $225,000, until we showed you photos of the property. It was in much worse condition than you imagined, and you were quite distraught that your daughter had been subjected to such living conditions. This was after you asked some real estate to send you photos, and all they sent you were outdated photos that portrayed the property in significantly great condition. Whatever your level of reluctance, no one coerced you to sign the contract.
$1,500.00 was offered to you to directly cover your travel expenses to WA from CA. This was a thoughtful concession on our part as part of typical negotiations. We also offered to cover the cost of a PODS for *** as part of the negotiation.
3 - Quote: The sale was completed on Dec 2, 2022 and to date I have not been paid the promised $1500 after a number of commitments and follow-ups.

We decided to not come up to scavenge the place, doesnt look like an memorable items of my daughter were left behind. However, as your folks are cleaning up the place, if they come across small items like jewelry, watches, purses, shoes that appear to have value, if they could set them aside and maybe you can do advise me as such. I appreciate your help through this mess that is everywhere. Good luck with the restoration, Im sure your crew will make it top class.
This text message on 11/30 is when ****** notified us that he wouldnt actually be traveling up to WA after all. Instead, he recognized that we were helpful enough with taking photos, that he preferred to just pocket the $1,500.00. Unfortunately, its a flat lie that the $1,500.00 was simply offered in general. The specific purpose of offering this concession was so ****** could come see the property in person.
****** also forgot to mention that on 11/29/22 when the settlement estimate was issued, the $1,500.00 was not shown, because he specifically requested the funds NOT to be listed on the purchase agreement, because he and *** dont have a good relationship, and he thought *** might not sign off on that. Thus, Foursquare was not bound contractually to pay these funds. We were still willing to cover ******* travel expenses of $1,500.00, until he opted out at the very end.

I am rejecting this response because:Foursquare response regarding the payment of a mere $1500 is full of total lies, total fabrication and total distraction from the truth.They can only allude to verbal conversations which never took place. We exchanged many phone messages, and they cannot point to a single word about payment for my travel to Bellevue. This false claim puts them in a cheap and low class business!
Attached to this response is the screenshot from the initial messaging:It is this text that got me into their crooked trap for a commitment they never intended to meet.
Anyone considering doing business with Foursquare, beware of their price undercutting and shrewd practices.There are independent realtors in the area with connections to investors and contractors that will offer far better deals. I was working with one that firmly offered $280K versus their $225K, but they trapped my broke son-in-law into this crooked deal.

This is a scam. Other people have also complained that this is a scam. They set themselves up as property investors, then they make all of these promises and they keep none of them. With me, I hired them to sell my house. It took them seven or eight months, and absolutely no results. Two deals fell through, because they failed to fix any of the issues that were wrong with the house. In ******, it is illegal to sell a house that has structural damage. They lied to me constantly, telling me that I would have the money in less than 30 days, telling me that they fixed all of the problems, when they actually fixed none of them, telling me that they had found a cash buyer, which was my requirement, but that was another lie and they actually found a poor couple, that did not qualify for any loans. In the end, they ended up costing me my entire savings account of over $50,000, that I had to pay in hotel bills while I waited for them to sell the house. Everything they do is illegal. They also treated me with an enormous amount of disrespect. I was discriminated against because I am a woman. They would yell at me and verbally abuse me. Several times they hung up the phone on me when I was in midsentence. And most of the time I could not contact them because they just would not return my call. It was an enormously stressful time in my life. I read a review about them once from a woman who bought one of their homes. She stated that absolutely nothing had been fixed and that she had to move. They lie and they drain your account while the fool around and don't fix anything at all. Also, we had an agreement in place that they would keep my furniture for staging purposes and that they would send me my items via ****** Instead, they cleared out the whole property, either stealing my things or trashing my things. We are a professional real estate company that often purchases properties in poor condition with complicated homeowner scenarios.
*******'s (aka *****) thread of unsubstantiated accusations are vague, hyperbolized, lack supporting evidence, and simply false.
When we first spoke with *************************** about the purchase of the property located at *************************************************************, the property was vacant and in very poor condition. There was human f**** and urine on the walls of the property, as an example. ******* was living out of state at the time.

Response #1:
We entered into a contractual agreement with ******* agreeing that we would pay all the costs associated with getting the house in marketable condition and all selling costs, including realtor commissions, inspection repair costs, title and escrow fees, etc.
The first expense we paid for was a 5+ day old water leak. We also had to handle the human feces, urin, and other unsanitary issuesextreme filthwithin the house, and we can provide photos upon request. The roof and foundation also had issues.
As part of our agreement, we hired a professional real estate agent to list the property on the MLS.
As far as results, we procured 3 different buyers, but every time, after due diligence periods, the buyers terminated the transaction due to the amount of work. This had nothing to do with us, but rather the wretched condition of the property and scope of work needed.

Heres an example of an extraordinary false claim. What proof is there that our company was personally responsible for any loss of personal funds of ********? It was our company paying for repairs on the property, so where was this $50,000 lost to?
Please reference Exhibits A, B and C. This is a screenshotted text message thread of ******* expressing appreciation for us cleaning up her house and tending to the yard. She then asks us for money for a hotel, and we sent her $1,000.

More serious accusations that are absolutely false and cannot be proven. We are seeking legal counsel for whether to pursue damages for defamation if needed.
None of these false claims can be supported with evidence. We have receipts for work that was done, and we have the witness of the professional real estate agent involved with the transaction.

More false claims. We requested that ******* provide us a list of anything shes like to keep within 10 days of the trashout. She did not provide a list, and as mentioned before, when we inspected the interior of the property, human feces, urin, liquids, and other extreme filth had ruined everything. Photos can be provided. Nothing of value remained in the house.
No single item was in salvageable enough condition to use as staging in the house.

We dont force or coerce any homeowner to do anything ever. Nothing in real estate can be done without mutual, written consent of all parties within a normal, un-coerced context. Regulations protect homeowners from situations like this.
Ultimately, the listing was taken off the market, the real estate agent decided not to continue working with *******, and we submitted a termination.

I am rejecting this response because:They are just lying again. When I left the home in February, the home was broken into by squatters. There was a bit of a mess, but there was no human f**** or urine, that is ridiculous. When I had my attorneys examine the pictures, it was determined that what was on the floor was mud. And that would make sense because there were extreme rain storms that were hitting the area. And I have a dirt driveway on my property. That means that the rain wouldve turned it into mud and whomever was squatting in my home was likely tracking mud throughout the house from their boots. There was nothing on the walls. If you open the pictures
, You will see that my furniture is in the background. I can provide these pictures let me know if you need to see them. You can see my bed and my couch and you can see some stuffed animals. All of them were in perfect condition. Also, I provided the list long before their little trash out. I can prove this and send you the email and you can read the timestamp on it. As I have stated before everything that they say is an absolute lie. They were careless with my property and they got rid of hundreds of thousands of dollars worth of items such as television sets, ballgowns and designer purses one of which is valued at $4000. They let two deals fall through because they did not fix anything at all. My current buyer can attest to this fact. If anything was fixed in the house then I would like to see the invoices. I asked for the invoices at least 20 times during their little novation period. I was never given the invoices and I was never kept in the loop about what was going on with my own home and property. They made all the decisions. They never returned my calls. They caused me so much pain and such severe stress that I ended up in the hospital recently which I can prove. I am also homeless and living out of hotels. I only have $300 left. They failed to sell my house in eight months, and I fired them. They claim that they sent the termination letter, which is true, but I fired them first and I can provide you with the text messages should you ask. I also fired the agent. I also had my attorneys issue all of the parties involved a no trespass order. That is how bad things got. I will say this again:they failed to sell my house as promised, they used fraudulent and illegal and unethical methods to try to force the buyers to purchase the home, such as trying to force them to sign an agreement that stated that the buyers would not have an inspection done. That is terribly unethical and possibly even illegal. I did not know that they were doing such things until after the fact but I was very upset about it. Instead of just fixing things they made a cash offer to the potential buyers and, like I said, they try to force them to not get an inspection done. Once I had fired for Square and the agent, I took control of the property and I sold it in one day. Let me say that again. One day. So I still cannot understand how foursquare can possibly or a reasonably state that they are real estate investors that can sell a home, when they could not sell mine in eight months. I am 44 years old and I have never ever complained about A business to the Better Business Bureau. I dont go around making fraudulent accusations. The things that they did were horrible and the public should be aware that they should not work with these lowlifes. And in reference to the few text messages that I sent thanking them, the only reason I did so was to secure the $1000 that was promised to me so that I had A place to stay. They told me they were going to take care of me and pay my rent, my rent was over $3000 at the time. I ended up getting evicted because they refused to cover my rent. I was desperate and facing homelessness and that is the only reason that I ever sent them a nice text message. The other text messages were pretty nasty I can send you those if youd like to read them. I will be requiring that they send me a cash offer for all of the items that they either stole or discarded from my home and also for the $50,000 that I spent on hotel rooms and what not as I waited and waited and waited for them to do their job which they never did. I require that they make me an offer or I am going to court with them and that is for sure. I have already retained an attorney. They will be charged with grand larceny, property damage, fraud, sexual harassment and many other things. They will lose their licenses and could possibly face jail time and expensive attorney fees. I will definitely take them to court unless they make me an offer. I have never worked with a business that has been so disgusting and so unethical in my life. They literally got rid of all Of my items even my furniture. There are pictures that I could never get back. They took my life away basically. How would you feel if that was you? I am left with nothing. I have one suitcase full of clothes and thats about it. So they can either make me a cash offer or they can face me in court.

This occurred between August through September of 2022. We were selling our home and a deal had fallen through so I put some leads out there and Foursquare contacted me saying they would like to buy my home. They preferred to speak over the phone and hardly responded to texts where I would have had actual evidence of what they were saying. They (****) initially told me they would purchase my home for I believe between 394k. We signed a contract, they told me 2 week closing and no inspection. Come to find out they DID do inspections because in the contract they had included an amount of time that allowed them to do it but when I was speaking with **** he said that was just typical contract jargon and that it was no inspection. Upon inspection that I did not know of or consent to they came back and told me that there were a lot of issues that were unforseen and they needed to lower the price and once again extend closing. They knew we were in a bind and took advantage of that by taking as much time as they could between our inital signing and this change and told me we're going to have to be closer to uh 350 is how he said it. I was upset but they knew at that point didn't have much options. I came back with 375 and because that was a middle ground and they said no, it's 350 or we walk. So again extended closing date by 2 weeks, and added another amount of time they could inspect or change their mind, again telling me it was just contract jargon. They said they would send me the inspection never did, refused to correspond through email, then they called me again and told me my house was a DRUG house, refused to embelish or send documents told me i had 20 minutes to sign or they walk not allowing me any time to contact anyone about it. I did end up contacting my city which said it was all a lie that even if I did grow drugs in my house it wasn't against the law. WE DIDNT BTW. So they got me down to 315K and extended closing ONCE again. I think they are scammers.Business response

We are a professional real estate company that often purchases properties in poor condition with complicated homeowner scenarios.
When we first spoke with ********************* and her husband concerning the purchase of the property located at ***************************************************, they communicated a rushed situation. They had already moved out of the state, and the property was in an abandoned state.
Attempting to facilitate a purchase with an expedited closing time frame, we submitted an offer sight unseen at the price of $390,000, which the Macks signed. We then scheduled a site visit to view the property in person.

Response to complaint #1:
Please reference the attorney-approved, attached Purchase and Sale Agreement (***) that our company uses and used for this home purchase (see Exhibit 1 - Purchase & Sale Agreement 390k).
Its important to note that the *** used is a simple 3-page contract written in easy-to-understand language and formatting.
Section 5. FEASIBILITY PERIOD is highlighted. The language is clear about our companys due diligence period, and the seller explicitly, ...permits Buyer and their representatives and vendors prior to transfer of title to perform inspections, appraisals, repairs, and obtain general contractor bids.
We believe the Macks may be misunderstanding the difference between a typical home inspection, which is common with owner occupant purchasers, and a feasibility period that happens to include inspections. A home inspection was never conducted by a professional home inspector. However, the property condition was absolutely inspected by our contractors.
Segments of Sections 2 and 8 are also highlighted, because both the ******* money deposit and closing date time frames are based on the Feasibility Period, which further draws attention to the importance of this section.
Furthermore, referring to Sections 14 and 15, our contract proactively insists that the Seller consult both a Tax Professional and Legal Counsel.
Were an established company that purchases properties across the nation. We close all our transactions with a professional ************* and either an attorney or professional Escrow company. The accusation that we (****) would attempt to rush, or otherwise mislead, the Macks concerning the Feasibility Period being typical contract jargon is unsubstantiated.

We occasionally will make offers on properties sight unseen. However, in these cases, it is our standard process to then conduct a site visit, take photos, gather contractor bids, verify the condition that was told to use by the homeowner, and re-evaluate our contract terms based on the findings.
A major issue that was not disclosed to us prior to signing the contract was that the foundation was weeping into the basement, which means that moisture was penetrating through the foundation into the basement. The solution to this was digging around the entire foundation, down to the footings, which because of the existing basement, had to be about 8 feet down. A french drain then had to be installed. This is a significant, costly repair item by itself.
The basement egress was not up to code either, which significantly impacts how an appraiser will value the property.
These are a couple examples of our findings. Please view the attached photos for a better understanding of the general condition of the property, and the scope of work needed to improve the condition of the property to move-in ready, retail market value.
Another major, indirect issue affecting the purchase price is the sudden and rapidly declining market conditions. We have to project what a property will be worth 2-6 months from now, and the current market conditions are gloomy.
In this case, we let our first contract with the Macks expire after the 7-day feasibility period, before signing a new *** (see Exhibit 2 - Purchase and Sale Agreement 352.5k).

*** #1 ($390k) had only a 7-day feasibility period. *** #2 ($352.5k) then only had a 2-day extended feasibility period. This is a very short time period, especially considering the foundation issue and the magnitude of the scope of work needed.
All terms are plainly written and agreed upon in writing. And we were, in fact, under pressure by the Macks to move faster than our typical time frames, in an effort to accommodate their unknown, urgent situation.
The closing date was not actually extended by 2 weeks. Whats important to track is the Feasibility Periods for both ***s. The first *** was mutually signed on Aug 1, 2022, while the second *** was signed only 8 days later on Aug 9, 2022.
Gathering sufficient contractor bids for the foundation-related work, trying to bring the basement up to code, and updating the entire house was a significant challenge that we were up against, while trying to accommodate a short closing time frame desired by the Macks.
Again, Section 5 Feasibility Period verbiage clearly sets expectations about what our due diligence may involve.

One of our financial partners called and told us they believe the house had been red-flagged by the City for something marijuana related. Ultimately, we were not able to obtain conclusive documentation for this specific issue, otherwise we would have provided.
Again, we werent the party needing to rush in this situation. The Macks had a personal reason for needing to do so that wasnt disclosed to us. We also understand that in business, ******* or coercing a homeowner is immoral and doesnt support a long-term vision.

The final price was determined by contractor bids, scope of work, economic impact, and the options with our capital partners.
The final addendum also included the closing time frame that we could reasonably do for this project.
Theres one situation that wasnt mentioned in the complaint. Three weeks after the price adjustment and closing date extension addendum was fully signed, the Macks informed us for the first time that they were purchasing a new house and needed us to close early.
Closing early wasnt an option, so as an alternative, we released the $7,500 ******* money deposit as non-refundable to them prior to closing to help make their new purchase possible.
