He took my check and money and made a staircase that shakes and has no railings- it doesnt meet code. He took 3 months to complete it and then makes an unusable staircase. Its a safety hazard. He refused to fix it.Customer response

I have reviewed the response made by the business in reference to complaint ID ******** and find that this resolution is satisfactory to me. The business owner Mr. ********************** reached out to me via text to return the amount of the stairs and send me a Venmo payment back to resolve his unsatisfactory work. I will then have another contractor repair the stairs for me instead of having him re do them since he did not perform satisfactory work. He at least provided a monetary payment back so that I can get it repaired.The fence he provided was fine, it was the staircase that was not up to building code. Please let me know if you have any questions.

We contacted CherryandSon for an aluminum fence quote. ***** Cherry came and measured the property and gave us a quote of $7000 for black fencing with 3 gates and $7500 for the same in white. In October 2023 we entered into an agreement with ***** Cherry and paid him $6000 before he would order the fence. We paid with a cashier check. He said it would be about 2 weeks for shipping which took closer to 6 weeks. ***** contacted us in early December 2023 to install the fence. He said its a 2 day job. First day he left around noon and very little done. He informed us the order did not contain the correct posts needed. ***** reordered the posts and that he would contact us when they are in. ***** finally returned to finish the job in March 2024. He and a coworker were there for another partial day. The following day ***** showed up to inform us that some of the fence posts are damaged and he needs to reorder. So after some discussion about temporary fencing and payment for labor performed I paid ***** another $1000 for work performed and declined a temporary fence. After 5 or 6 weeks of not hearing from ************ contacted him in mid April for an update. He informed me that he had emergency eye surgery and was unable to do anything. Shortly after that ***** told me the fence he ordered from Menards was discontinued and he could not get any posts. Since then there has been much back and forth trying to explore options and get this fence finished. It is now July 2024, I have paid $7000 of $7500 for a fence that is 2/3 done. I contend this fence no longer has any value since it cannot be completed properly. ***** offered to drop off what materials he does have and $300 to walk away. That is not acceptable to me. I prefer to have the fence I paid for completed as promised or a full refund plus removal of what has been installed. I have tried to resolve this issue and warned ***** this was the next step if he failed to finish or negotiate a mutually acceptable resolution.Business response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Mr ********************** has 2 viable options to finish this fence. He can have the 3 white blank posts professionally cut to match the others that he has already installed or I believe he stated the black posts were still available and he could have those professionally painted to match also. Mr *********************** compromise leaves us with a portion of the fence that wont match the rest. Mr ********************** quoted us for 160 of fence and 3 gates. To date, one gate and 56 of fencing has not been installed. We paid for and expect a fence that is consistent in appearance and quality. I have offered to review Mr *********************** option but he has not arranged to present it. If his solution is noticeably different, we cant accept it. Mr ********************** has my number if he wants to schedule a visit. We would like the agreed upon fencing solution completed by 8/10/24.
