On May 19 2023, we paid ************************* at DPS Masonry a down payment of $1,500 via personal check (cashed) for masonry work ******* agreed to do on our property. Throughout the months of May-October, ******* would respond to text inquiries from us about the planned timing of the work that he would be there by the end of the month. On October 19 2023, ******* again replied that the work would be done by the end of the month, and then blocked our phone number. We sent e-mails and called/texted from an alternative number. On November 21 2023, he replied via e-mail that he would complete the work "middle to end of next week." We replied that the end of the following week was fine, but otherwise we would want the $1,500 deposit back. On December 1, we again sent e-mails letting him know that given the work had not been completed and our difficulty getting ahold of him, we wanted the deposit of $1,500 via check. On 7/24/23 DPS agreed to replace some (~25%) of our damaged patio planter box for $1500 and re-tuck point the bad sections on the rest of the planter, resetting or replacing the concrete caps. Additionally agreed to install a frame for privacy lattice and capable of supporting hanging flower baskets, similar to original design, for the cost of materials. After job commenced on 10/9/23, DPS informed us the planter box was in worse condition than assumed and would not be possible to rebuild w/o significantly more time and $ above original contract. We agreed to not rebuild planter box but continue with privacy structure, emphasizing it still needed to be able to support the weight of hanging baskets. Directly asked DPS if he had requisite skills and knowledge to construct the structure. DPS assured us that he was qualified and we would be happy with the results. No cost reduction was offered for not doing any masonry work (besides demolition and removal) or supplying bricks which seemed WRONG. My Dad paid DPS $400 for materials for privacy structure. Shortly after the work was completed, we noticed one of the three main support posts was wobbly and swaying in even a light breeze. The lattice was bowed and the adjacent support was also being pulled out of plumb. Even if the post had remained rigidly upright, structure is too flimsy to support weight of hanging baskets anyway as DPS did not use any cross member supports. Sent photos to DPS via text on 10/27/23 of leaning support post and called DPS, who agreed to come out the next day and repair. DPS never came out nor provided explanation. Both my Dad and I have since left DPS messages asking DPS to rectify situation and got no response. At this point, we do not trust workmanship or skills of DPS to rectify and request minimum $1200 refund as we will now have to hire someone else to re-do the work correctly. Doubt we can re-use most of the materials either, so we will have to pay again to replace them.
