I have a car that i purchased from ******* approximately 10months ago. After 2 weeks of driving it i had noticed a problem with the transmission so used their warranty to get it fixed. Feeling confident in my decision making i took it to lee myles transmission to have this done. After 2months of waiting i recieved my car back as it seemed to be fixed. Couple months later i notice a worrying sound that seemed to comw from clutch. Then clutch became very stiff amd shifting became rough mainly in 2nd gear so then i knew something was wrong so i took it back to repair shop because thats what the warranty company advised. They took a look and after telling me i needed a new clutch system that they priced with labor around 1650 out of my pocket because being a normal wear part even though i had just gotten it. After agreeing they call back a week or two later stating that i also needed a 300 dollar flywheel. I sadly agreed having no other options and when they were done approximately another week or two later i hadnt even made it a mile and still had a rough time shifting into 2nd making the same noise as before so i turned right back around. They said they would take a look the next day. Couple days later they said that they THINK they didnt bleed all the air out properly and tried to assure the noise is coming from my exhaust which does rattle but its nothing like that. That being said i do have certification in Automotive Technology and it really sounds like something was misdiagnosed from the getgo because second gear stills makes the noise and seems like its getting worse. Remind you i havent even owned it a full year plus still owe 10,000 atleast on it. Also requested old parts but never got them.Business response

To whom it may concern,
In regards to ID********* *** ******** 2011 Subaru Legacy’s transmission, a high mileage (used transmission “Junk yard”) was used because the warranty company offered that option and it was the cheapest route for the customer and they didn’t want to pay the extra to have it rebuilt by us. This being the case there is no warranty for the transmission because we didn’t provide it. That issue is between Mr. ****** and his warranty company/the junk yard they got it from. That addresses the 2nd gear complaint. We have his flywheel, clutch and throw-out bearing. The noise he was hearing was his throw-out bearing. We suggested replacing the clutch at the same time.
To address the need for the flywheel, until the transmission is removed from the car at that time we couldn’t tell it needed a flywheel. Cost aside, we feel obligated to point out issues as they are noticed. Whether the car was purchased recently or not does not change that issues exist. Yes it did have an exhaust sound as well. Lastly, if the customer is still having any issues he has yet to contact us, however has clearly contacted you instead, I would advise them to contact us because they are voiding there warranty by not at the very minimum notifying us that a problem still exists. From our perspective the only discrepancy we have made is an air bubble that required further bleeding. *** ****** is welcome to his parts at any time. Though we do sympathize with *** ****** having just bought the car, we don’t decide his warranty policies and to what they will and won’t cover. That being said, how much is owed and when the car was purchased I don’t believe were factors for the warranty company’s decision making process.

I have reviewed the response made by the business in reference to complaint ** *******2, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I can't seem to understand how I hadn't notified them of the problem. The whole reason I had taken it back within minutes of getting it back. Also find hard to understand how I could easily see the problem with the transmission but the garage could not? Which all this had contributed to the warranty being now too late for. Warranty company will not replace it if they say it wasnt a problem which i had informed them on when bringing it in for the clutch and it shifting rough. Repeatedly ask if my transmission was bad cause 2nd gear felt the worst and only had so many more miles for warranty and was definitely not a problem. When i got it back it was OBVIOUS that 2nd gear was still rough so immediately took it back and 3 days or so later claim it was an air pocket needing bled out. Mind you i havent had the vehicle a full year yet and its been in there parking lot about long as its been in mine so when I got my vehicle back this last time and not even get home and it acts up again if it even stopped wasnt sure at that point i had been struggling for a car to get back and forth to weeks so i was done thought about taking to another garage but with warranty company recommended that garage because they did prior repair. Im pretty sure if the warranty isnt through its not even within garage distance but I am now broke to scared to drive it out my driveway still struggling for a car and still owe 10000 on this one that should be top shape giving the fact that its been in and out of this repair since i bought it.
