      Date of the transaction Our contract with YYC General Contractors was signed on Feb *, 2024. The work started around Mar *. It was scheduled to be finished June **. We told the contractor this date was required because we had company arriving. The contract was finished on July *. Money We have paid YYC General Contractors $********* and are withholding $******** to cover;* $***** for work that was not required on "Balance owing for work done on original Contract". * $******** The contractor's cost required to repair the flooring in main bathroom (as described in their quote #****). In other words if they don't repair the flooring then we keep $*********Contract The contract asked for * bathroom renovations with some extra work; installing gas line from basement to kitchen, joist repair and electrical and panel upgrade. We can provide a copy of the contract on request.Dispute There are several issues at the end of the contract;* Unfinished work in both bathrooms. We can give you a list on request.* They are billing us for original contract work that was never done. For example, kitchen hood installation, no City of ******* permit was provided for gas line or electrical.* Poorly installed toilet. The toilet tank is not installed correctly. * We complained about main bathroom flooring installation. The contractor created a quote #**** (*********) for cost of repairing the flooring. If they complete this quote then we will pay it plus return $******** from the original contract.Resolve the problem We have sent several emails to YYC General Contractors since July *, regarding finishing the bathrooms, but they refuse to discuss our concerns. On July **, they replied "I will be happy to return and discuss the issues you claim have not been addressed, after you pay $******* which is still overdue." According to them, we're only allowed to withhold **% - $*******

      Home owners chose all flooring and bathroom fixtures. Main floor bathroom vinyl plank flooring item number SKU ********** ******************** was sent to me by email dated April **/24. We installed their selection, which is a ********** *****. ********** is responsible for color, shades and hues of the Product they sell. The first time we installed the vinyl plank on the main floor bathroom floor, there were darker and lighter planks installed. Home owners wife did not like the darker planks so we got more vinyl from ********** pulled half the floor apart and used only lighter planks to make homeowner happy, at this point the main floor vinyl plank has been installed.. After * weeks homeowners wife did not like the floor and color they chose, so they began asking me to provide a quote in case they wanted to change the floor down the road. I explained that this would cost extra over and above the existing contract because this would mean pulling toilet, vanity, baseboards, tiled backsplash and paint touch-**** I also said we would not be responsible for damage to any bathroom items that were removed. When I asked for payment at the end of the job, home owner asked me to sit down at his table and proceeded to try re-negotiating the contract i said no way. I was give a check on July */24 for $******** and withheld $ ******* and that if I wanted the balance of what was owed I would have to come back and re-do that bathroom floor. Home owner says fix- Fix what? bathroom is beautiful as his wife said she just doesn't like the color of the floor they chose. So try to process this we installed their chosen item ,pulled the floor apart to install lighter planks and now home owner wants me to come back to do the floor a 3rd time for free because he withheld payment from a quote he asked me for. he still hasn't paid me for the original install. I included phots of main floor and basement bathroom everything looks great.

      Home owner says his bathroom floor needs to be fixed where is the proof? send in a picture like mine your bathroom floors is awesome. I have more Pictures. Home owner is not being truthful and he is using this platform to waste my Saturday. I quoted on a hood fan from Amazon Stainless steel the item is called Hermitlux for $189.99 also to vent fan to exterior, my cost to exhaust hood fan to exterior is $***. I told home owner I'm fine to have him subtract $*** from the Bill but no response. I even told home owner I would be more than happy to return for any small warranty items. I have all item selections home owner. Each day we came back and there were little pieces of tape in spots so we did the touch-up even though we were not finished the job. then on final day we spent 1 hour in basement bathroom where he would point out spots he wanted more paint applied, even areas of shadow. Home owner said he was happy with everything and then gave me a check that was not the amount due. Home owner asked for extra work to be done as well. Home owner said gas line wasn't necessary, then why has my Plumber booked an inspection this week for an an extension to existing gas line for future gas stove on main floor? The plumber will be charging for Permit and his time.

      I am rejecting this response because:

      *** City of ******* permit for gas line

      On August *, a City of ******* inspector inspected the gas line work, but we are still waiting for a copy of the permit. In any case, since you are refusing to finish the job without first being paid in full - we will still be withholding this amount. We have already paid you $*********. Please finish the job.

      Here is a list of the outstanding issues with some pictures;
      Main Floor bathroom;
      m1 2 tone flooring, needs repaired (picture)
      m2 Wrong colour paint used on repair (picture)
      m3 Floor vent installed incorrectly. The baseboard is installed on top of the floor vent. 
      m4 Missing baseboard near vanity 
      m5 Around door hinge needs painting

      Lower bathroom;
      1 Toilet tank not installed properly. We purchased the size of toilet you suggested (Rough-in 12"). If you had other requirements then you should have said. You should have never installed the toilet. (picture)
      2 No caulking around bath tub (picture)
      3 Shower head not sealed
      4 Paint baseboard edge near toilet 
      5 Near toilet, Paint bottom of drywall
      6 Utility room, flooring, gap on last tile
      7 Paint door - needs more paint
      8 Paint baseboard edge
      9 Paint near Vanity coming off (picture). Do you use paint? How many other places have this issue.
      10 Cleanup caulking along bottom edge of bath tub
      11 No caulking along edge of bath tile
      12 No caulking around vanity (sink)
      13 Cleanup red marks (glue) on caulking, and clean tiles
      14 Missing electrical plate on ceiling switch for furnace
      15 Poorly painted around bedroom door
      16 White caulking should be painted same colour as wall. It is for the main floor bathroom.

      We replied to the contractor on ***. They replied to us on **** with the same message (and pictures). Are we suppose to do something or is this still with the contractor?

      We are resending August 7th reply to BBB with pictures.
      You mentioned these costs at our July 4th meeting;
      550 kitchen hood 
      150 kitchen hood installation (my guess - since you didn't give an amount)
      250 City of ******* permit for Electrical
      250 City of ******* permit for gas line

      On August 6, a City of ******* inspector inspected the gas line work, but we are still waiting for a copy of the permit. In any case, since you are refusing to finish the job without first being paid in full - we will still be withholding this amount. We have already paid you $67,379.70. Please finish the job.

      Home owner is a liar! look at casing by mirror in Picture. Casing has been painted as you can see. I have Permit from city for gas line- It passed. you are complaining about minor things i said i would  address under warranty. you are are just trying to get a free flooring job done over and over and over and over again until you no longer see imaginary things on the flooring you chose, *********** not my Company is responsible for the colors and hues of the vinyl product they sell and that you chose . As I said before we installed flooring once, then again pulled it apart again and re-installed we are not doing it again. I gave you costs regarding fan over stove and coring also permitting you new that because I told you.  If home owner was willing to ********************* up concrete in basement bathroom and turn the basement bathroom into a bigger project he could of let us know, it would of moved toilet further into tub space or maybe home owner was willing to ********************* up the basement bathroom floor to move rough-in 2 inches, cant see that happening cant even pay his original bill . Home owner kept saying he wanted to stay close to the contract price. I am will to do paint touch-up on trim on main floor bathroom as well as add more caulking around basement bathroom tub. However I would rather subtract $500 for fan over stove and coring and $125 for caulking around basement bathroom tub and a couple of paint touchups. I just cannot stand anyone who has trouble telling the truth. If I do not receive payment in 1 week I will seek to recover what is owed. Do not reply.

      We are replying to BBB only because contractor is threating legal action and stated do not reply. We are withholding $2,958.75 from original contract, please let us know how much we are legally allowed to withhold for deficiencies?

      FYI There is NO caulking around top of basement bathtub and sink. The shower head installation is not complete (see previous picture). Therefore the basement bathroom is not finished. We purchased the toilet size (rough-in 12") that the contractor recommended. It should never have been installed - it doesn't fit! We are withholding $2,958.75 from original contract until they complete the job. This includes the work mentioned in invoice #****. Once #**** is completed then we will pay invoice #**** and return $1,758.75 for work that is not yet done.
