On June 25, 2024, Next Day Delivery LLC and Matthew Willes entered into a Default Judgment with The Arizona Attorney General’s Office. The Judgment settles allegations that the business and Matthew Willes left marketing materials, in the form of door tags, on consumer’s doors with the caption “Sorry We Missed You”, implying consumers should call to reschedule delivery, deceiving consumers that they were a legitimate delivery service to unknowingly provide their contact information and consent to receive telephone solicitations. Under the terms of the order the business and Matthew Willes are permanently enjoined and restrained from distributing advertisements that appear to be delivery slips, but are not delivery slips, distributing advertisements that mislead consumers into believing the advertisements are something other than advertisements, distributing any advertisements for the purpose of the collection and sale of consumer’s personal information, making misrepresentations in order to mislead consumers into providing consent to receive telephone solicitations, selling any consumer personal information, making telephone solicitations for goods and services to consumers whose personal information was previously collected through the door tags and jointly and severally pay a civil penalty of $727,247 and $6,222.80 to cover the plaintiff's costs and $169,033.80 to cover the plaintiff’s attorney fees.
