I inquired with this company for hard money funding for a real estate project in the *****************. I had several correspondences with the broker, ******************* for the funding, which was planned to be processed with *** Lending.I was provided a pre-approval for the funds with *** Lending and I was instructed by POM Capital to get an appraisal on the property and a preliminary title report, both of which I obtained and paid for out of pocket. The appraisal was $975 and the preliminary title report was $150.I had questions on a need to obtain a survey of the property, and it appeared to me that **** was unsure of the process. I called *** Lending to clarify if a new survey would be needed and I was told immediately that they have never lended in the ***************** and are unable to do so. I then needed to begin my refinance process from the beginning with a different lender. The new lender cannot use the appraisal nor the title report I obtained and as such, I requested POM Capital to reimburse me for those funds spent since they should have known the lender could not lend in the area where the property was located. I spoke with both **** and the owner of POM Capital, *************************. They both advised they would not be responsible for reimbursing me and that they simply made a mistake. In fact, when I spoke with *****, he said "I'm not getting anything" and he hung up on me.In my experience, POM Capital is not qualified to be a lender of funds and I am pursuing a small claims action against them to be reimbursed the money unnecessarily spent. I am also pursuing a formal complaint with the banking department in the ***************** to file a formal complaint.
