    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved.  We are providing a summary of the government’s allegations, which have not yet been proven.

     

    On June 17, 2020 the Ohio Attorney General’s Office filed a civil lawsuit in Athens County Common Pleas Court against defendants Marcus Fultz dba Danielle’s on 2nd, and Ellen Fultz dba Danielle’s on 2nd. Marcus and Ellen Fultz sell products on Amazon under the name danielle-on-2nd, in which they acquire a variety of types of products and resell those products to the general public via the online platforms Amazon,eBay and Etsy, according to the state.

     

    According to the Ohio Attorney General’s Office, the defendants allegedly saw an opportunity to profit off the pandemic as the demand for health products skyrocketed, and they rapidly acquired bulk quantities of hand sanitizer and listed them for sale, increasing the price by as much as 1,017.3%. Amazon records show the couple made more than $26,700 from the sale of 600 Purell hand sanitizer products in February and March,  compared to the average cost of the same products sold on Amazon in January, for example, Marcus and Ellen Fultz charged $39.44 for 8-ounce bottles of Purell Advanced Hand Sanitizer Refreshing Gel, a product that cost $3.53 on Amazon prior to the pandemic., according to the state.

     

    The state is asking that the court order the defendants jointly and severally liable to pay consumer restitution and to pay civil penalties,


    The matter is pending.
