CAP Promotions Inc.’s  salespeople provide in-home sales presentations for the Kirby vacuum system. The salespeople are considered to be independent contractors who receive the unit to sell from a Kirby independent, authorized Distributor. There is no financial investment required to become salespeople, however the equipment used for demonstrations is the property of the distributor and is to be returned in good condition, otherwise the salespeople will be charged for the equipment, including fees for cleaning or repair.  The value of the equipment is listed at $2499.  Neither the salespeople nor the Distributor is an employee of The Kirby Company. The salespeople are paid on commission only and receives his/her earnings from the Distributor. 

Cap Promotions Inc. offers their salespeople various sales incentive programs to encourage sales. One program the business offers pays their salespersons $450/week just to demonstrate the Kirby vacuum system.  In order to qualify, salespeople must perform fifteen qualified demonstrations within a 7 day period.  If salespeople do less than the fifteen qualified demonstrations per week, the only compensation that they will receive are the profits from any sales. Because they are considered to be independent contractors, salespeople are not subject to minimum wage laws.
