On July 1, 2022, as part of an industry-wide review of CBD businesses in our service area, Better Business Bureau contacted USA Hemp Co concerning the following advertising claims found on their website, https://usahemp.com/:
- "YOUR NATURAL CHOICE FOR A HEALTHIER LIFE"
- "Change the World of Natural Medicine by Improving People’s Lives through CBD. We strive to educate the world on the incredible benefits of hemp extract and provide high-quality hemp cannabidiol (CBD) products"
- "Stress, anxiety, and body pains are the leading causes that affect the quality of life. The sufferers end up being unproductive, and even the daily routine tasks become a burden. But not to worry anymore, USA hemp has the solution"
- "USA Hemp’s flavored CBD oil not only tastes better but also rehabilitates abnormal sleep patterns that allow you to lead a healthier and comfortable life"
- "90% Sleep Better, 86% Feel Active, 79% Improves Appetite, 84% Feel Happy and Calm"
- CBD Product Descriptions include unsubstantiated health claims.
- Website's Blog page. Blog posts mention multiple unsubstantiated health claims.
- "QUALITY GUARANTEE. Let's get down to it. If you're not satisfied, we're not satisfied. We want our products to actually work. That's why we'll happily give you a refund on any USA Hemp purchase if it fails to deliver results". BBB Could not locate the terms and conditions for the money-back guarantee on the company’s website.
BBB requested that USA Hemp Co review its advertising and provide substantiation based on reliable, recent, competent testing for each of the health claims made and to discontinue any advertising that is in violation of FDA and FTC mandates for this industry.
Despite written requests, as of October 31, 2022, USA Hemp Co has not responded to BBB’s request for revisions and clarification in its advertising.
Advertisements should be truthful, sincere offers to sell. Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request. All advertising that may mislead or deceive consumers should be avoided.
Claims relating to performance and results should be backed up by reliable evidence.
When using the term “warranty” or “guarantee” the advertiser should clearly and conspicuously include a statement that the complete details of the warranty can be seen prior to the sale which could include putting it on the seller’s website. Advertisers should disclose any material limitations on a "satisfaction guarantee" or "money-back guarantee" and define, for consumers, the meaning of claims such as "lifetime guarantee".
