Contract amount: $5000 (two payments of $2500 via Zelle) to email ********************** Another email that is used is ******************************************** ***** ******* came to my house to look at the job, he told my father on the phone, who was paying for the project, that he didn't see anything that would increase the price quoted. When they were power washing the house, he showed me some rotted wood that he said needed to be replaced at an additional cost of $1050. I Zelled him the money immediately. With this money, the project total increased to $6,050 instead of the agreed price of $5000.PLEASE SEE THE ATTACHED WORD DOCUMENT THAT WILL EXPLAIN EVERYTHING IN MORE DETAIL. (not enough space provided here) IN ADDITION, I HAVE UPLOADED A COPY OF THE CONTRACT AND SOME PHOTOS SHOWING THE FINISHED PRODUCT.
The additional details:
Date of transaction July 2, 2024
Contract price: $5000.00 (after negotiating)
Additional work (replacing some rotted facia): $1050.00 (paid by my daughter)
My daughter, who lives in **********, ** owns a 2700 sq. ft 2 story house and needed to have her house painted. She found DLS Contracting on **** and signed a contract with ***** *******, DLS Contracting from *********, **. As a gift to my daughter who needed financial help on this project, I spoke with ***** and we agreed on a total price of $5000 for the project. He also knows that I am a Senior citizen and live in *******. From our phone conversation and my daughter's interview with him, everything seemed to be on the up and up. He seemed anxious to start the job and after I Zelled him a $2500 deposit, he and a helper came to the house and started to power wash, which was included in the contract to remove ****, etc. from the house prior to painting. His intention was to start very early and said that he could complete the project in 2 days, which I felt was VERY ambitious considering the scraping and condition of the wood. In any case, he and his helper arrived at 11:30 AM and left early due to rain. They came back the next day and supposedly completed the job at around 9:00 PM that evening. As you can see on the contract, he estimated that the project would take 5 or 6 days. Also, their truck wouldn't start and my daughter had to help jump the battery to help. In the morning, she found that they used her extension ladder and left it standing against the house for her to remove. Sloppy and unprofessional. A very long story short, my daughter lives alone and was very nervous with two guys asking for final payment at night. There was no way to properly inspect the house because it was dark outside. She made them aware of areas that were not completed or done properly and they said that they would come out after a project that they were doing in **********. She called me that night with the guys there and asked for the balance
to be paid. She was uncomfortable and for her safety, I Zelled the balance. After many texts back and forth and excuses of his helper quitting, fired, injured or who knows what, he made many promises to make it right. There were a couple of appointments set up by ***** and he did not show up or call. In one of the texts, he gave the excuse that he was injured in an accident of some kind and we would have to wait until he was better. We have several texts and conversations that we can produce showing the run around and promises and basically, we were scammed as it is September 4th and nothing has been done.
In addition to everything, I asked why he didn't paint the shutters and he told me that they were not part of the house and that it would be an additional charge. In my world, anything on the house is part of the house and his contract clearly states that he was to paint the complete exterior. Also, included in the pictures attached, please see where they painted right over the chips in the paint instead of scrapping first. Add to this the fact that during his inspection, he told me that he saw nothing on the house that would alter our price of $5000. As it turns out, he hit my daughter up for another $1050 to fix some rotted wood.
This is the worst paint job that I have ever seen. In the texts, he keeps apologizing and uses the statement "at my earliest convenience and opportunity". The texts that we have clearly show that the job wasn't done and he has done nothing to correct or finish as promised. To date, he has made no attempt to remedy this problem and I am hoping that you can help us. Basically, we are out $6,050 and the house looks basically the same as when he started.
