On September 6, 2018, BBB Serving North Central Texas observed several advertising concerns that were forwarded to BBB Serving Greenville South Carolina as this is the headquarters location for Mattress by Appointment. BBB requested substantiation, in part, for advertising claims such as "largest selection of hybrid mattresses", "best price guarantee", "save you up to 50-80% off retail", and "We offer brand new mattresses made by the nation's largest suppliers at 50-80 % off the retail price factory direct to you".

According to the Basic Principles of the BBB Code of Advertising, "The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any claims or offers made before publication or broadcast and, upon request, present such substantiation promptly to the advertising medium or the Better Business Bureau."

Per Section 8 of the BBB Code of Advertising, "The terms 'factory to you,' 'direct from maker,' 'factory direct,' 'factory outlet' and the like can be used where all advertised products are actually manufactured by the advertiser or in factories owned or controlled by the advertiser."

Section 28 of the BBB Code of Advertising also states, "Superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, like '#1 in new car sales in the city,' can be proved or disproved."

As of October 24, 2018, the company's headquarters location failed to substantiate, modify, or discontinue the advertising claims brought to its attention by BBB Serving Greenville South Carolina.
