      We started conversation with Oliver in the end of August, 2022 , later we entered in contract with Texas Fiber Glass Pools, Inc. to repair the spa leak at Baymont Inn & Suites Initially, we wanted the following repairs of spa: 1)Spa's leaking jets 2)Resurfacing 3)Change interior plumbing Upon checking Texas Fiber Glass Pools stated that plumbing is old and fragile, so they offered to change the entire plumbing, heater, filters, and motors was well. Revised Contract with all new additions. Second week of September :- Even though material outside can be purchased at the half price, we still wanted our spa to be fixed up & running and we agreed to get the work done. -Texas Fiber Glass Pools staff went in changed the heater and filter. - I noticed while checking their work that Vac Alert was placed in the wrong spot as per the other Vac alert installed, they agreed and redid the whole pluming again . After a week, when their work was done, they told us to wait a day and then fill in the water to check. (We did as per instruction) Upon checking: -Plumbing was still leaking -Filter was still leaking -Pressure in the jets was wrong: 3 jets had lots of pressure and 4 had zero to no pressure. After communicating all the findings to Oliver, he admitted that his employee lied to him and install wrong bodies and he had fired him. Oliver requested more time and agreed to redo the work. -I have to wait another week to get the spa fixed again now. -Texas Fiber Glass Pools took another week to refix everything and upon finish they went straight in for payment. -I said to them once I will inspect and see everything is done correctly, definitely I will pay my dues. -But Texas Fiber Glass Pools was very insistent on the payment and threating me with charging 2% penalty for each day. I was not denying the payment -Upon filling water, we found: o Plumbing was still leaking o There was no pressure in the jets o When we start the motor, air pipe started to pump water out o No bubbles o Circulating pump was not filling up the water correctly o Water is still going down , ( Leak is still there ) -Next day their one of employee came and manually opened the jet bodies, which is not correct in the commercial spa. * Zulle asked for proof from old spa, which we did sent the pictures and videos. * Upon receiving the pictures and videos, the project manager was changed from Zulle to Logan. Zulle never answered back and logan gave us two options to fix the issue: o To leave the jets permanently open, and o Installation of extra blower, which we never had before. * I told Logan you guys need to pull the city permit and get this job done as per city code, but Logan texted me that for this job they don't need city permit. But I reconfirm with city inspector , they company should pull the permit before they start work . Given options by Logan are not the right fix to spa, so they send 3rd party consultants - Gary and Chris. * I never received any reports from their inspections about the equipment installed. * Upon personal discussions with them, they did agree the work done is not with in the correct standards. * I had also got another inspection done by third party on my behalf and they did agree that the different jet bodies are installed, which is not meant of this system . I just want my job to done correctly, that's all. I am losing 20% of revenue every day. Longer my spa remain closed more revenue loss for me. I been very patient and cooperative with Texas Fiber Glass Pools staff to resolve this situation. All I want my work done in correct way that's all!!

      Business Response /* (1000, 5, 2022/12/02) */ Mr. ***** In response, you have prevented us from performing any additional work on the spa without a permit, which you did not ask for or require initially. You say you have a report that shows the alleged shortcomings of the work performed but you have refused to share it. You are circumspect about what you want done, having changed your mind about what jets you want installed on the spa, etc. Recall, we installed the same jets your spa had on it originally, but you complained about the lack of bubbles. At your insistence, we replaced the jets you initially wanted, with jets that you selected, despite my client telling you that if you want "more bubbles", you need to install a blower (which TFPs was willing to do at its cost), but you refused. Our lawyer has been in touch with you and you still owe 90% of the total. We have finished the work and still have no payment from you. Consumer Response /* (3000, 7, 2022/12/05) */ (The consumer indicated he/she DID NOT accept the response from the business.) This response clearly indicates the dishonesty, false accusations, and lack of knowledge of work this business is involved in. As to your response, I am asking for permit only after your third attempt to fix my spa. If Texas Fiberglass Pool had fixed it correctly at first time this situation must not come up. I am attaching the proof of email where I had shared the third party's inspection report which clearly mention TFP's shortcomings and wrong jets installation. So, this allegation is a lie that I refused to share the report. Please check the mail sent by me on 11/21/22 at 9:09am( Also attaching that mail here, Please check attachments) I never changed my mind, TFP don't know which are the right jet bodies need to be install. Again, despite of me telling TFP that we never had blower before which clearly proves that wrong jet bodies have installed which was not there earlier. I had given so many chances to TFP to resolve this matter and gave them endless chances to fix my spa but they are not willing to accept their wrongdoing. My spa is not fixed, its been shut off since which is causing revenue loss for my business. Since, my spa is not fixed as it should be fixed, job is not done, nothing is repaired correctly, thus, we do not owe anything to TFP as this job is not finished. I offered numerous times to TFP fix my spa and they will get paid but no response and showed no interest to fix their mistake and wrongdoings. Business Response /* (4000, 9, 2022/12/07) */ Mr. ***** never provided a report that he allegedly has. He only provided a excerpt via email. We asked for the entire report; he has never provided the entire report. Secondly, the permit issue is a red herring. It is not required in this case and he has refused to pay for the permitting. TFP has offered to install a blower, at its cost, but Mr. ***** has refused. The purpose of the blower is to increase the bubbles in his spa. Despite what Mr. ***** says, TFP has installed the same jets that were in the spa before, but even then he was dissatisfied. He continues to complain about bubbles, but he will not allow TFP to install a blower, which would increase the bubbles in the spa. Mr. *****'s excuses do not relieve him from paying for the other work performed on the spa, but as of today, he has not made a single partial payment. TFP is displaying their dishonesty right here, when TFP stopped communicating directly with us and assigned their lawyer ... I had provided the report in the attached along with the excerpt , please check the attachment in my emails for the evidence, but in fact TFP never their shared their report for two inspections done by them. Permit Issue indicated their lack of knowledge. As per City Inspector ,TFP should have pulled permit initially to finish their job. I had sent the attachment from city inspector stating a permit is needed for this job. This is the 3rd time I am giving this information that I provided the report in email i sent on 11/21/22, also I sent the same report in my previous response given here . We never had blower before and why should I get blower for additional noice and electricity expense for future. We are not the one making excuse, but TFP is not taking responsibility for doing their job incorrectly and my spa is still leaking, so we are not liable for their incomplete job and incompetent work. Please check the attached email i sent them for permit requirement
