To the Consumer,
I am very saddened that the homeowner has concluded that I do not fulfill my obligations to my customers. Therefore my reply is as follows:
In June 2017 I signed a contract to install a new roof for ***** **** the homeowner.
I fulfilled the scope of work according to the agreed upon and signed contract and gave a
two-year workmanship warranty which would explicitly apply to the agreed upon and signed contract. Not until July 2021 did the homeowner call me to express any concerns of a leak pertaining to her chimney. However, she did call me either in 2019 / 2020 to help her repair a piece of siding that had been blown off by apparently high winds. I responded favorably and did not charge her.
So on July 29th 2021, I immediately set up an appointment to go and assess the situation. I took extensive pictures of the exterior roof and the chimney. I also took pictures of the interior ceiling around the chimney and her floors around the chimney. After a thorough inspection I explained to the homeowner my findings.
Many areas of the brick exterior of the chimney were deteriorating with mortar deficiencies resulting in numerous cracks, fractures, and holes. The obvious result was potential water intrusion from multiple points of entry. Regarding the flashing detail: I did not install new counter-flashing though it was in satisfactory condition. However, I did install new a step-flashing system along with the underlayment barriers to prepare for the new installation of new shingles. So after several weeks the homeowner still concluded I was responsible for her leaks. We then participated in several meetings presenting our positions. After those meetings I once again stated my position.
My Position as Follows:
The homeowner's chimney problems needed a Chimney Masonry Expert. All homes as they get older began a deterioration process including chimneys. Maintenance work is a critical preventive measure. Therefore after thorough inspection along with the consultation from several different Construction Experts the decision was agreed upon that Jody The Roofer was not negligent regarding the fulfillment of his scope of work as the roofer as specified in the contract.
