In July 2021, I asked McAllen Valley Roofing to come give me a quote on re-roofing on my two houses. My primary residence was tile and my other house was metal. Juan came out the next day. He said my home with the tile roof could not be repaired because the Italian clay tiles were no longer made. He said they would take them away. My other house had a metal roof. I told him that I wanted to keep the metal to use on chicken coop or other things here. I took out a loan for the roofs at that time. Two weeks later; I called to let him know that I had decided on shingle roofs for both houses. He came to the house the next day for the shingle choice and for me to sign the contract and give the information for the debit from my bank account. On 08/08/21, McAllen Valley Roofing withdrew $5,107.50 for my home and $3672.50 for my other house. I did not hear from them after that. I called Juan on 08/30/21. I had made the first loan payment and nothing had been done. He said the shingle I wanted was out of stock. I had to make a second choice. They came out on Labor Day to start the roofs. They were gentle removing and stacking the metal roof until my daughter told them I was keeping it. They then started tossing it to the ground. The Italian clay tile roof from my home, was very carefully removed and stacked on a trailer. They drove off with the tiles and old metal gutters (they left the downspouts) and I haven’t seen them since. My riding mower has roofing nails in the tires. They left trash. They never put the gutters on. They did not paint the eaves. When contacted, I was told they’d be out Friday, then Monday, them Friday. I gave up. They didn’t fulfill their contract. The contract states they would pull permits. I called my city permit office, said permits were not pulled for either house. I live in a coastal county. No inspections were done. No windstorm certification on the roofs They started sending invoices 2 months later. Breach of contract.

      To whom it may concern,

We did receive two contracts from Ms. ******** and work was completed on both homes. All of the items in the contracts were fulfilled with the exception of the 6" gutter installation on one of the contracts. In our notes we show that we tried contacting Ms. ******** on separate occasions to try to install the gutters but were told several times she did not want us at the property. A credit was issued in January on the invoice for the gutter installation as it was not performed.

Regarding the permit, I called this morning to confirm the city of La Feria does not require a building permit for shingle roofs. As for the windstorm certificate, it is not stated in either contract that they were included. Our project managers are instructed to write it in to make sure that our production department applies for the windstorm certificate and so our accounting department knows it was included in the price.

At this time a refund cannot not be given as all the work has been completed and a credit has been issued for the gutters not done. We can issue a credit for the nails in the tire and get the windstorm certifications at no additional cost for both homes but we would require 90% payment as a show of good faith and the remaining 10% when the windstorm certificate is received.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.

I would have paid the total amount if the job had been completed.  The job was not.  I sent pictures to your Project Manager showing what was not done.  I got the run around.  Juan would be out this day.  No show.  Juan would be out this day.  No show.  Multiple times.  Then, no one answered my messages.  Two months from the first visit until the roofs were put on.  One month after I paid half up front before roofs were done.  I had to pester to get that done.  Two months after the roofers left was the first I heard from your company.  I received ONE phone call from your company after the roofs were done.  The “new project manager” did not know anything about what had happened and did not care to listen to me.  I told her we were done.  That was the first and last time I heard from McAllen Valley Roofing unless you count the invoices via email and text.  I called Cameron County permit office.  I was told permits are required for any roofing or re-roofing project in Cameron County.  There is an initial inspection before roofing starts and a final inspection when roofing is completed.  Per the contract, McAllen Valley Roofing was to get permits necessary.  McAllen Valley Roofing did not do that, nor was the work completed nor trash picked up.  I believe I have paid you enough.

      To whom it may concern,

Since it does not appear that we will arrive to a resolution with the customer we would like to set up a mediation hearing.

The value of the material and labor provided to both homes far exceeds the claims being made and even with the offer to get the certifications and provide credits for the damage and work not done.

      Resolved
Dear BBB, My complaint with McAllen Valley Roofing is that I have diligently tried to contact and work with the above mentioned company over the past 9 months and have been put off and I am now being brushed off in attempt to repair a roof leak in my house. On March 23, 2021, I signed a contract to repair the roof and the work was completed on April 14, 2021. I had a clause in the contract that if we had an 8 inch. rain the company would come look at the property. On July 9, 2021 there was an 8 inch rain in the Weslaco, Texas and Mercedes area and the roof started to leak. It took three months before the company came to look at the leak. Calls or emails were made on July 9, July 15, Aug. 16, Sept 15, and Oct. 8. No one from the receptionist on up the Project supervisor returned my calls or emails On Oct. 18, several men with the lead worker named Jaime attempted to fix the roof, but it rained within 2 days and leaked once again. On Oct. 26, two men came and patched original work and left. On Nov. 3 it rained again and leaked 2 or 3 glass fulls of water. Each time following a leak, I sent the company pictures of standing water on roof and water leaking inside of house. On Nov. 11, they tried real hard to stop leak and workers spent day working on house. They put more layers of adheasive then waited for 6 hours and then repeated. It rained 2 days later and leaked again. I showed pictures to company and supervisor said that following the 3rd attempt that let the owner take a look at the leak. The man stated that on Dec. 7, 2021. I have waited for 2 months and no one has come to take a look at property and leak. The consideration paid for the leak repair was $5,250.. The repairs on other sections besides the main leak were and are all acceptable. The leak in the house/porch area still remains focal point of my complaint. I fear there is going to be bad damage as a result on not repairing the leak to the porch area of the house.

      To whom it may concern,

We went to the customers house and we resolved the issue.  The customer was very pleased, in fact didn't realize the outcome of his complaint and wanted to retract the complaint and turn it into a compliment. The leak has been fixed with no further issues.

      Regards,

I haven't responded to McAllen Valley Roofing since the tried to repair the leak in my roof.  I have only contacted BBB and stated

that the leak was not repaired satisfactorly.   I contacted Ms. Sandra ***** and a lady named Hilda and that has been all of the people I have contacted.  I sent pictures of the problem to two separate phone links to the BBB and a letter about the lack of repair to BBB  Houston.  Thank you.  When the owner of McAllen Valley roofing surveyed to property, I sent him a thank you note for personally evaluating the leak.
