Mike (Evergreen) ###-###-#### Refund Request $1,500.00 I was seeking services for turf grass; there was not an expected date for services, after down payment was rendered by Evergreen, because services had to be approved by the Homeowner Association -Liberty Community Management (###-###-####) located at **** ******** **** ** ***** ***, Loganville GA 30052, prior to any materials being ordered or a service date provided. The services where for Turf Grass provided by Evergreen, front and backyard. When inquired about the Turf Grass, Michael N***** from Evergreen explained that the HOA usually will approve backyard Turf Grass. I explained to Michael that I prefer that the HOA approve the backyard and front yard Turf Grass. At that time Michael explain that my backyard was not large enough to have services completed and that the front yard would need to be approved. I explained to Michael that if the front yard does not get approve I chose not to move forward with any services, and he agreed that would be fine. On 5/22/2023 @ 7:12pm, I texted Mike stating that since I have been going back and forth with the HOA and the modification request for Turf Grass decision was still pending; I did not want to move forward with any services and requested for a full refund of $1500.00 due it being over a month waiting for a responds from the HOA. I explained to him that I just request to have my refund. Michael texted back on 5/25/2023 stating that "Ok let's talk Thursday so we can process it. On 5/24/2023 @ 1:00 pm, I texted Michael sending a reminder stating "Please don't forget to process my refund as I stated a couple days ago and I no longer want to move forward with services. On 5/25/2023 I never heard from Michael, so I called him on 5/30/2023 and was unable to reach him. In addition, I left a message and did not receive a return call. On 5/31/2023 I called Michael again, he answered and I was informed by him that my refund could not be refunded because the HOA approved the services. After checking my HOA portal; portal indicated that the modification request was still in pending status. I explained to Michael and he still want to insisted that I was wrong and to contact the HOA. I did contact the HOA, but it has been difficult trying to get a representative to return my call and provide me with information. I strongly believe that Michael does not want to return the refund because he will missed out a redeeming the cost of the services. In addition to several attempts of trying to contact him, I have via email him a copy of the modification denial letter from my HOA stating that I can not move forward with turf grass for front or back. As of today, I have been texting and calling Michael and he does return any of my text message or voicemail message.
