    Division of Consumer Protection Complaint

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.

    On March 1, 2022, Utah Division of Consumer Protection (the Division) filed a Complaint against Avolta Power, Inc. and Bello Solar Energy, LLC for failure to comply with an administrative subpoena issued on November 22, 2021. The subpoena seeks "a copy of each version of any contract(s) used to sell residential solar systems to consumers from January 1, 2020 to the present date, and un unredacted copy of each contract for any consumer who cancelled the contracted described above. The subpoena further requested the businesses to identify whether the consumer was charged a cancellation fee; if so, the amount of the free and how much of the fee the consumer paid; and any consumers whose accounts were sent to collections as a result of non-payment by the consumer of the cancellation fee. 

    The Division asks the Court to enter a declaratory judgment that these businesses are in contempt for failure to comply with the Subpoena and order them to show cause why they should not be compelled to appear and comply with the subpoena.

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.

    On April 26, 2022, the Minnesota Attorney General filed a lawsuit in Hennepin County District Court. Charges filed allege the business, three of its executives, and several lending partners engaged in deceptive and fraudulent practices in marketing and selling residential solar panel systems. The suit alleges these individuals and entities violated several Minnesota state laws against consumer fraud by leading consumers to believe they were partnering with utility companies when they were not,  that they were signing up for information only to be tricked into signing a binding contract, and by exaggerating how much money could be saved. The matter is pending.

    Approached by door to door salesman in December 2020. We are senior citizens and the sales pitch sounded appealing: we would save on utility bills, and our panels would pay for themselves with tax rebates but we had to hurry because the credits would be expiring. The contract was put in my name (credit rating?). The total for the installation and panels was almost $50,000 for which we still owe over $48,000! The panels stopped producing in January of 2023. This company has defaulted on the contract, and therefore we are stuck with paying for panels that do not work! Our power bill has increased ($200 for 8/23) and the cost of panels has increased to $233. We were told that our tax rebates would be around $7,000 which could be applied to our loan. This has not NOT been the case. We feel totally conned, and to take advantage of anyone, much less seniors, is despicable. We contacted the loan company who gave us a list of solar companies in ************** who could "fix" our solar panels. We have reached out to one who is scheduled to look at them. Also, after finding out they were out of business, I researched and found out that there is a class action lawsuit against them in *********. The solar companies named in the complaint have been able to continue operating under new names through a doing business as filing after appearing to close. Bello Solar was one of these named.
