On September 20, 2024, in the State of Washington King County Superior Court, the State of Washington and Seattle Arena Company, LLC entered into an Assurance of Discontinuance. According to the Settlement, Climate Pledge Arena will pay $477,917 in penalties and refunds as a result of an investigation into a hidden fee the arena charged thousands of Washingtonians.
Seattle Arena Company, LLC does not admit that the practices described in the Assurance constituted unfair or deceptive acts or practices in trade or commerce that violated the Washington Consumer Protection Act, RCW 19.86.020. Nevertheless, Seattle Arena Company agreed it has discontinued charging the transaction fee and will not engage in the following practice in the future: Charging consumers a fee without clearly and conspicuously disclosing the fee in advertisements or other materials referencing a product’s price, and before the point of sale.
According to the order, from February 27, 2023, to July 22, 2023, Climate Pledge added a 3% fee to food and beverage purchases made at the arena. They did not disclose the fee in any way before customers made their purchase, in violation of Washington’s Consumer Protection Act. The Attorney General’s investigation revealed Seattle Arena Company charged the fee on approximately 183,000 transactions over the course of 37 events, bringing in $162,917.16. The legally binding agreement is subject to court approval.
As a condition for resolving his case, Climate Pledge Arena agreed to:
- Conclude a class action lawsuit resulting in full restitution to all Washington consumers who were harmed, to be administered through a claims process, subject to court approval; The proposed Class Action settlement establishes a claim fund in the amount of $162,971.16 for impacted consumers.
- Pay affected customers who file a claim an additional $10 for their inconvenience and loss of their money in addition to the full refund, if the fee cannot be determined, $1.00; Payments to consumers are prorated if claims reach the $162,971.16 cap.
- Pay $315,000 to the Attorney General’s Office to pay for the cost of bringing the case and future enforcement work.
- Disclose all fees it charges customers in the future.

Thank you for your feedback. Due to production delays with the tour, doors opening were also delayed for this event. This caused longer lines than are normal for events and concerts at Climate Pledge Arena. We do everything to avoid this type of scenario and experience for our guests. Unfortunately, some circumstances are out of our control. But, we do evaluate our procedures and policies related to guest experience after every event, and your feedback is important to that process.
