This company has called me at least four times a day every day for the last three weeks. I have asked them to stop calling me and remove me from the list and they guarantee me they have removed me but the next day for calls all over again. Even after talking with them and I call them back it goes right to a disconnected number. Every time they call me its a different phone number but the exact same spiel when I talked to them. I truly believe this company is a scam.Business response

I applied for a refinance with eMortgage Capital. *******, their loan officer, said to pay for an appraisal fee which I did in the amount of $550. ******* stated that all loan covenants were cleared pending the appraisal and to not make the October, 2021 payment. They did the appraisal. After that, the refinance was not approved, so I lost the appraisal fee. ******* advised me in writing that if the loan was not approved, I would be refunded the appraisal fee. After repeated requests for refund, no refund has been received. Communications with the company have been sporadic and they have not issued the refund as promised. I want eMortgagecapital to give me my money back because the lender did not approve the refinance. Thank you for your time.Business response

Unfortunately there is no way for us to issue a refund as we did not accept any money from the client. If client is disputing the validity of the appraisal then he must contact the appraisal management company who performed the appraisal and accepted the money for the appraisal for a refund. We as a company did all we can to get the loan and we were unable to fund the loan, thus we lost dozens of hours of work and received 0 compensation for our efforts. It is impossible to guarantee a loan and banks add the stipulation of an appraisal as a requirement of full loan approval. ************ can raise a dispute with the management company or try to apply with another mortgage company and we can release it to whomever he wished, he is the owner of the appraisal at it is considered chattel (personal property) he has only authorized it to be released to our company thus we do not have any ownership of the appraisal.Customer response

eMortgage Capital was paid $550.00 via credit card with the stipulation that if the loan was not funded, I would receive a refund. That is clearly stated by their representative in the original submission to BBB. I just want the company to honor their original commitment to refund the appraisal fee since they chose not to fund the loan.Business response

Unfortunately we do not accept any money and do not have the ability to accept a credit card payment the fee was made to the appraisal management company. Also we made every effort to try to find the loan and we were unsuccessful due to borrower qualification restrictions. The appraisal is a condition with our investors to get a loan, we need it in order to make the attempt of attaining a loan and a loan is not a guaranty. The appraisal is still owned by ************ and he can take that appraisal to any investor to get a loan as it is good up to 3 months and can be decertified for another 3 months.Initial Complaint

I was in the process of refinance my home with another company Gateway Mortgage before coming to E Mortgage. The ************* gave me a high percentage , i rejected that offer. Then i went to E mortgage and i start the process with them , The lady that was assisting me order an appraisal . The appraisal she order was FHA and she ended up receiving a conventional report . She told me to go ahead and call to cancel that and she stated i will get reimbursed back my 700+.. That instead she will use the appraisal from the Gateway Mortgage, since that was the first company that i went through. She ended up using that appraisal . She told me that i have to call to cancel the appraisal she order , again they sent her the incorrect one, and that i can get reimbursed . I left her many voicemails letting her know they wont return the money and she has to cancel it. No responds she ghosted me . I stop the process because she gave me high percentage as well. but still has not responded back no responded to nothing .Business response

Unfortunately we do not accept money for appraisals we are a mortgage bank so disputes with appraisals have to be taken up with the appraisal management company whom the client paid the monies to. Also there is no mention of whom the client was working with so we are unable to address the issue with the loan officer as that info is not indicated. In any case disputes about appraisal fees are to be addressed with the management company who was paid.Customer response

I applied for a home loan and told them I was not willing to pay a high closing costs. I told them I will not use their company and to stop calling and sending emails. They sent 3 more today and called twice. It is harassments and I am afraid they will hurt my credit.Business response

We apologize for the communication, this was a mistake due to multiple inputs inputs into our CRM which caused confusion and thus caused our agents to reach out a few extra times. We have taken note and will cease communication and sincerely apologize.Customer response

We closed our Mortgage with E-Mortgage Capital 12/20. Our loan was overfunded and we were to recieve a refund of *******. They said it was going to be wired. It never posted in my account and i contacted my bank . My bank instructed me to get the Lmad number to trace the wire. I asked them they wouldn't provide it. Finally after countless emails they said it wasn't wired and they would Fed ex me the funds in 2-3 days. That was on Jan 14, 22 i followed up and again they said an error was made and they were escalating this further that was on Jan 19th. So it's been a while and I don't believe they have intentions on honoring our signed agreement so I decided to file a complaint to 1. Try and get what we are rightfully owed and 2. Make sure as many people possible know of the unscrupulous practices of ************************* and E-Mortgage capitalBusiness response

Escrow is sending funds, and borrower will receive money within a few days. There is no way to control escrow in the state of ******** as they take much longer on transactions to balance. Sorry about the delay, please ************** for further updates this is not in our control unfortunately.
