On Saturday Dec 10, I went to Braman Motors to work a deal with them on a new car. I was sent a letter/email by the ** offering me a promotion of 2,000$ off MSRP on a new lease. I also was offered in writing a by the salesperson that I would receive a $2,346 discount off MSRP + **** in equity for the purchase of my existing vehicle. As I reviewed the financials to the offer with Financial Advisor *************************, I noticed that there was no discount reflected in the deal. I asked ******* and the sales person Waleed several times to show me where the discount was applied -- after being asked countless times to point to where the discount was applied in the offer, ******* admitted that he can't because it wasn't! **************************** and the **, also refused to honor the deal.I also used the dealer calculator to price the vehicle, which came out MUCH lower than what was being offered to me. They told me that the calculator was not accurate. (Why provide customers with a calculator if it's inaccurate?) I asked them to explain where the inaccuracies are in the dealer's calculator on their website. Finally, ******* admitted that they were trying to lease me the vehicle above MSRP "market price" and that's why the numbers varied.Basically they were trying to sell me mangos for five dollars that really should be sold for one dollar, then told me they would discount it by two dollars, trying to make me think like I was getting a deal. When in fact, I was not even getting a discount.Offering me something that they never intended to provide to me, is by definition false advertising, and against the law. This dealership wasted an entire day, misleading me into believing I was getting a deal and this is not the first time. Please see attachments for evidence of the offersBusiness response

The dealership respectfully disagrees with the customers characterization of the proposed transaction. We are advised that the customer mentioned the promotion a day or two after he left the store. However, the promotion that he showed the dealership was on a different model than the vehicle he was attempting to buy. The dealership and customer were unable to come to a mutually agreeable deal.Customer response

I appreciate the dealership looking into this complaint and replying back but I am respectfully rejecting this response because:The deal says: We are advised that the customer mentioned the promotion a day or two after he left the store. However, the promotion that he showed the dealership was on a different model than the vehicle he was attempting to buy.
The only reason why I visited Braman BMW was because I was sent offers via email by Braman BMW GM ************************* that other *** dealers were not offering. The emails with offers started in September and continued into October with 2x emails including the same offer, November with another 2x emails including the same offer and December with another 2x emails including the same offer. All offers included a 2,000$ factory-dealership *** loyalty credit of MSRP.
I also emailed ************************* in response to his Sept 27 email on that same day advising him that the sales team didnt offer me any such deals when I inquired with the internet sales team. I did not get any reply to this email.
I visited Braman BMW on December 9th, originally to sell my *** back to Braman who said they would buy it in the emails mentioned above. I had it appraised prior to Dec 9th and was promised up to 1,000$ in equity from the sale. Waleed the sales person helping me at the time asked why I was not getting another ***. I explained that I worked out a deal on a fully loaded Kia ** for less than what a 3 series would cost. ****** was adamant about finding me a deal and recommended I look at the X1. He added that he would get me the best deal. This promise of a deal is evident from the offer sheets provided to me at the dealership by the salesperson, Waleed for the X1. You can find this offer sheet in my original complaint titled BF2F2616-D6EB-4A9C-A5CE-4639B4CCC750.jpeg
We spent hours discussing the deal. ****** went to speak with his manager at least 4-5+ times and as a final attempt, promised to go to bat for me after I declined and said I would just go get the Kia **. Exhausted and late in the day, I agreed to put a deposit on the X1 based on the last number provided to me.T he X1 was ** transit and scheduled to arrive a week from the 9th.
The next day on the 10th, Waleed texted me about another X1 that arrived but with a different package. I told him I would go see it asap. After test driving it, we went back and he shared the numbers to lease the vehicle. We discussed how he arrived to the offer because when I used the Braman BMW and *** *** calculator, I arrived at different numbers. Later when I was discussing the Braman lease financials, I asked ************************* to explain where the discount promised to me by Waleed is reflective in the financial offer. The dealership and customer were unable to come to a mutually agreeable deal.
We were not able to come to a mutual agreeable deal because Braman / ************************* was not able to show me where the discounts are reflective in the financial breakdown of the deal.
************************* added the deal was between myself and ******. When I asked Waleed to point to where the discount was applied in the financials, he began to calculate numbers on his phone but was not able to show me where in the deal that the discount could be found.
Finally ************************* admitted that the reason the deal was different than Braman and ***s calculator is because the car was being leased above MSRP, based on market value. He also told me that any discount promised to me was not being applied to MSRP. I told them the only way I will do the deal, is if they can point to where the discount is being applied. ************************* ultimately said he could not do that.
He could not, because there was no discount being applied.
I later sent Waleed a text on December 13th with a copy of the Braman BMW offer dated December 9th, writing, Fake offer? I just got this letter offering me 2k off MSRP, what you all were saying you would not do.
Waleed did not reply.
It is clear in the offer provided to me in writing by salesperson Waleed that I would receive a 2,346$ discount on the car (*** X1) the dealer offered me since there were no *** 3 series available.
Additionally, I was also offered 2000$ off MSRP on *** 330 via email from Braman GM ***********************. Braman should have honored the factory loyalty credit extended to me in this email. I am still to this day interested in what was offered to me in those emails but Braman is not interested in honoring the offer.
Braman should have honored the discount provided to me in person by the sales person Whaleed.
Neither of which were honored when I inquired during my Dec 9 and 10 visit, nor my September email inquiry.
Braman should honor the original offer made to me in writing of discount of 2,346$ + 1000$ in equity for my current vehicle and base the discount off MSRP and lease the X1 or 330i at MSRP instead of market value due to the inconveniences and time wasted.
Sincerely,
*************************Initial Complaint

On October 25th I had purchased a vehicle being presented that the vehicle Im signing for is Certified pre owned. After driving the vehicle two days I realized it had a major issue and I had taken it back to the Braman Motors dealer. I then was told the vehicle was not certified preowned I signed and have contract indicating it is . I was misrepresented completely on the contract and I signed the deal expecting my vehicle to be certified Pre owned with warranty. I have attempted multiple times and personally gone to the Braman motors dealer and asked to please resolve my issue without running my credit. I have also inquiries being reported after being explained my credit application is still valid for the 30 days of it being ran for the deal. I would like to either have the car cpod as per our agreement or cancel the deal since they misrepresented what they sold me.Business response

Let's start with the service, I call to make an appointment because I have many issues with my car which is a lease. I call and speak to the agent who tells me to come in the morning, so I am guaranteed a loaner as I need one as I was headed to the hospital. I get there and they say sorry no more loaners. I see one guy that was behind me get a loaner. i speak to their manager and express that i was promised a loaner and she said impossible we don't do that. i show her an email where they are confirming my loaner. At that point she calls someone else who says i need to wait 20 minutes. the whole room of people were complaining, most of the employee's drinking coffee. i get a loaner that is NOT a *** which is fine I just need to leave. jump in the car that is sticky and dirty - had to use Clorox wipes to clean it. i leave - one of the reasons i took it was because i have a leak in my sunroof that is due to a clogged little pipe and the service agent calls me and says sorry not covered you have to pay $1,000. This is a lease and obviously something I did not do or can handle. I am not going to pay it because *** has the best warranty and service according to them, but a leaking sunroof is not covered.... then I get a text from the service agent that says your car is ready you need to pick up by 7pm or you will incur charges - it is 3:45PM and I work. horrible place. This is my last lease with ***.Business response

The dealership does not make final determinations on a manufacturers warranty. BMWNA makes the final decision on whether or not a failed component is covered under their warranty. Any issue that the customer has regarding warranty coverage, she should direct that complaint to BMWNA not the dealership. The customer should consider calling her insurance company to determine if anything may be covered by her comprehensive coverage.Initial Complaint

On September 15, I took my car in for back brakes and a sensor that appears when I start my car. The service technician for this visit, *****************************, was completely incompetent in every way. He called me to pick up the vehicle the very next day and when I arrived, I turned the car off then on again to check the sensor and it's still there as I expected. I have learned from experience with 2 BMWs that Braman's service is not top notch and should always be double checked. ******* told me they would have to check the sensor out therefore, my car was actually not ready. I live in Westchester! No apology at all; very rude and condescending. My normal service advisor, ************************, couldn't be bothered to help me since I wanted to bring the car in ASAP and he was going on vacation the following day. Once I got the diagnosis back, they tell me my car has had alot of body work and now has a leak that my warranty will not cover. I have not had work done to the car and requested further information. I have not heard back. The worst part, my breaks still take too long to stop and are now squeaking. Tired of the bad service at Braman, I took my car to ********* where they informed me the issue is not over $1900 as quoted by Braman and should also be covered by my warranty. I am also outraged to be told I still need back brakes and the pads nor the sensors have recently been replaced. In so many words, I was told Braman has scammed me and they also did not put the parts back together carefully under my hood. ********* suggested I return to Braman to fix the issue under my warranty since only they know what damage they have done under my hood. I want a refund ASAP of the money I paid ($671.51) for a service which was not rendered. Do not take your car to Braman, you will be overcharged for bad service and the work may or may not be completed. I am willing to pursue every avenue for recourse.Business response

- Leased new car July 16, 2022 - That night after the purchase after heavy rainfall noticed heavy condensation( water in headlight) in driver side headlight. - When contacting the dealership the next day, they urged me to bring in the car as per dealer "water in the headlight can lead to corrosion and electrical failure" - Dealer has had my car for the past month and half to tell me that this is "normal". - When purchasing the car, car was in the garage so the water wasn't present. - Previous customer same dealer had 2 other cars, no issue with headlight - Dealer wants to return the car, they can't find a fix.-This will be the 3rd time they try to fix.Business response

They never told me it was a warranty issue. They always told me that This is how the cars are and that its normal. They never once mentioned anything remotely close to it being a warranty issues. Even with pictures of proff that my car is defective, they still dismissed me.

I went to *** Miami a couple months ago because I had a oil leak on my *** but car was still running perfectly. I was told the car needed a value cover and oil filter to stop the leaking I paid $2,400 for them to fix it. After fixing it the next day I seen oil leaks in my driveway still, I called bme Miami they told me to take it back in for a diagnosis which I did that day. The next day they told me the mechanic put the value cover in wrong but they would fix it free of charge since it was their mistake. I got my car back the following day and when I got home and let it sit in the driveway for a couple hours I still seen Oil leaking from the car. I called them they told me the same thing to bring it in for a diagnosis and they will look at it again so I took the car back for service. The next day I get a call from my service advisor that the car been leaking from the oil pan and gasket the whole time after I already spent $2400 for a value cover and oil filter and that the person who did my oil change last messed up my drain plug from over tighten. I complained about the value cover I had fixed and filter which was very expensive said okay I will let it sit and fix it in a couple months. While driving home I noticed my car brakes acting up my car was driving strange and higher milage then before I let them know. Later on that yeat I called them at the end of the year of 2021 and had them fix my oil pan and gasket. When i got my car back the next day I woke up to oil stains all over my driveway. I called them they told me to to take it back for service which I did later that day they told me they did the wrong repair on my car and they would fix it. A couple days later I get my car back after spending $2,000 on new oil pan and gasket and I noticed when I start it I seen drivetrain malfunction on my computer screen and that the car was shaking, Higher mileage then before, my brakes squeaking and my car not accerating properly I called them and they refused to fix it.Business response

We are advised that the customer initially brought his vehicle in to service department complaining of an oil leak. After diagnosis, it was determined that the vehicle required a new valve cover gasket and the customer authorized the repair. Shortly after the repair, the vehicle began leaking again. The customer returned to the dealership and it was determined that the new valve gasket that was installed had a small crimp in it. The gasket was replaced again at no charge to the customer. Several months later, the customer returned to the dealership, again complaining of an oil leak. This time the diagnosis revealed a small crack in the oil pan that was caused by an outside service facility. The customer authorized the repair of the oil pan. Now, one year later the customer is complaining about issues unrelated to the two repairs made previously. If the customer is having any issues with the repairs that were made by the dealership, he should contact the dealership to bring the vehicle in to correct the issues consistent with the manufacturers warranty on the parts that were installed.Initial Complaint

I am a military veteran that had served honorably for ***************** and have been to a few conflict campaigns throughout the world. I registered to take advantage of the military incentive discount, through the national channel of Mini's [www.miniusa.com] and this incentive warranted me the amount of $1,500 of the selected vehicle that I requested to order, which the amount to order was $250 once the order has placed, you would need to use a credit card to reserve that order. I made contact with the Braman Mini in Miami and I had spoken to the Sales Managers there. They did not want to honor the incentive that the national Mini website was publicizing. Nevertheless, I then requested to have my $250 refunded back to me. The Sales Manager reported to me stating that it will take awhile, possibly up to (3) months.I have called several times speaking with all various managers from that location, none of the managers to include the general manager would be helpful in assisting me. They had mentioned that they will look into it and contact me back but I have never received either a phone call or email concerning the case of my deposit returned. It reads on the mini website, that the deposit is fully refundable. After waiting and speaking to a few managers and sales representatives of the issue, now they are telling me that there is no record of my deposit on their end that they have that can corroborate my claim.Business response

My car leasing is ending on August 27th and I want to buy my leased car. ******* laws require lease customers to do the buyout process at a dealership so I went to Braman Mini on August 2nd to start the lease buyout process. The associate asked me to sign few documents to proceed, 1 of the document had blanks and the associate was talking a lot to keep me busy and not paying attention. This document was a buyout pre delivery service charge addendum to voluntarily agree to pay an additional $2,367 for certain additional items offered by the Dealership such as a safety inspection, title transfer assistance, expedited processing, presentment of finance and insurance, and/or preparation of additional documents (pre delivery charge) I was told that it was normal procedure for a lease buyout. Since when asking a customer to accept the violation of the lease is normal procedure? Especially a document with blanks spaces that are filled post signature! I knew that doing this process at the dealership would be risky but I was hoping that Braman would be different thanks other dealers. I refuse to pay these fees so I left furious and very disappointing because there were no other options. Respecting the lease agreement was not an option.Business response

I am rejecting this response because I have now all the documents to support my claim. First Braman Financial didnt specify a condition of the payoff anywhere, the balance payoff was $23162 , the quote never mention dealer delivery fees for 2367$, but they want to sign a affidavit pre delivery fee that state you voluntarily agree to paid this ADDITIONAL fees .charging sale taxes county taxe when it have been paid and included on my monthly payment for the past three years ( see document) invoice billed do not matched the new registration
the Dealership failed to honor the paid off quote agreement made by Braman financial fraudulently adding service and changing number from the different invoice.
Since now I bought the car I want difference paid back! It s unbelievable to have to face this, otherwise will bring this to courtSincerely,
