      Want to surrender the timeshare. There were several misrepresentations and facts left out of your seller's sale pitch during our presentation at the Grandview in Las Vegas. The following points, important points, were not disclosed: we had a 5 day grace period to rescind; the maintenance fees will continuously increase, there are additional fees that may apply when exchanging a week, our weeks only start on a Friday, RCI has very little availability, and that we can only travel during the even years for our weeks. Your salesman ensured that the maintenance fees remain the same and that we would be able to travel anywhere at anytime for $249. In addition to this misrepresentation, we were all under the influence of alcohol at the time of signing the contracts, in which, your salesmen were aware of and encouraged. Being impaired during the signing of this contract alone, should void this agreement as we were not fully aware of what we were signing. Again, we are attempting to resolve this with you all, the seller, instead of taking other measures. We are sure you aim to please your customers and a $7000 purchase will not, at all, put a dent in your multimillion dollar business. We are respectfully requesting that our contract be rescinded. We are not seeking any refund in monies already paid. The following is information you may need to access our account. We have been unable to use due to no availability, we have paid consistently despite being financially strained due to Covid. Please take back the timeshare, you all have made a profit.       Re:       Complaint ID ******** (the Complaint) filed by ***************************** regarding the timeshare purchased by ***********************, *****************************, and La *************************** (the Consumeror Owner) from under Contract No. ******* (the Contract)

      To whom it may concern:

      Eldorado Resorts Corp. (Developer) is in receipt of the above referenced Consumers Complaint concerning the Owners purchase of one (1) biennial timeshare interest of a one (1) bedroom unit known as Assigned Unit Week 28, with Even Year Usage beginning in 2022 at ********************** (the Timeshare). Please accept our apology for the delay in in responding to the Complaint.

      As background information, Developer has registered the Resort with the ***************************, which regulates timeshare resorts in the state of ******. The Consumer documents used by Developer, including but not limited to the Public Offering Statement, comply with the statutory requirements of the ****** Law regulating Time-Share Sales.On a daily basis, Developers managers and supervisors provide on-site training to Developers sales representatives.

      We have reviewed Consumers Complaint and the allegations contained therein, as well as the Owners file. The following is our response to the Complaint.

      The Complaint alleges that the Contract was not represented properly. We deny this allegation. Developer and its sales representatives exercise great care in educating each prospective purchaser about what they are purchasing. The closing process is divided between a Sales Representative and a Verification Officer. This split process is deliberate and serves to eliminate any possible confusion consumers may have regarding their purchase. ********* makes a concerted effort to assure that each prospective purchaser makes an informed and educated decision as to whether or not to purchase. All of the terms, fees and costs associated with the purchase (including the maintenance fees, taxes and exchange fees) are documented in writing for mutual protection. Owner participated in the entire sales and closing process and had the full opportunity to ask any and all questions before signing any documents and making the payment of the deposit.

      The Complaint alleges that maintenance fees and taxes have continuously increased each year. We deny this allegation. Owner has not realized any increase to their maintenance fees and taxes as they have only been billed once for maintenance fees and taxes for the year 2022. How is it that they can claim this when they have not experienced any increase?

      The Complaint alleges that Owner was not informed of the statutory rescission period. We deny this allegation. The statutory rescission period is disclosed in bold font at the top of the Contract and again immediately above Owners signature on the Contract. After the signing and closing was completed, Owner was provided with a complete copy of all of the documents that they signed, including the Contract, for the records.
      The Complaint alleges that *** has very little availability and that Owner can only travel during the even years for their assigned week. We disagree with these allegations. Resort ************************* (***) is the largest exchange company in the world and offers the worlds largest vacation exchange network. If Owner wanted to travel during an odd year, they are able to do so by depositing their even year and exchanging for usage during an oddyear subject to ***s procedures for depositing and exchanging timeshares. ***s customer service department can assist Consumer with any questions concerning the *** exchange program.   

      Additionally,under our reservation system, an Owner has up to thirty (30) days prior to their Assigned Week to reserve the use of their Timeshare. Thus, if Consumer wanted to use their Timeshare they could simply contact the reservation department thirty (30) days before their scheduled Assigned Week and reserve their unit.Please note, as a condition to using their Timeshare, an Owner must be current on their maintenance fees due to their Association.

      I am rejecting this response because: everything in the response is thoroughly spelled out and was not during the presentation at the resort. As previously stated, we were under the influence of alcohol which was encouraged by their sales associate. We were not informed of the recession period despite them saying it was in bold print on one of the many documents. Despite the claim you can travel anytime, anywhere as stated in response and by salesman, that is not a fact. I just tried booking for SC about a week and a half ago and nothing is available. Tried booking for ** last month, nothing was available. So Im paying for something thats never available. And the company has told us the maintenance fees will increase so although we havent experienced it yet, we know its coming and this is something that wasnt disclosed either!

      i have a couple of family members who were told of the trip they called paid the 199.00 Later we were all told we couldn't take advantage of the voucher at the same time. So i'd like to get a refund.
