Manheim Kansas City General Manager ************************* and Assistant General Manager *************************** retaliated against me after we contacted the Manheim Headquarters regarding an arbitration case in which they manipulated the policy to favor their location. Since that situation, **** wrote me up for a code of conduct as retaliation and revoked my access to purchase cars. I have contacted customer care to investigate this matter; however, I have not heard back from anyone. They failed to provide supporting documentation for the code of conduct and instead bullied me and took away my access. Attached is an email showing the ** policy manipulatingBusiness response

The claim that was mentioned by **************** was unwound from the end buyer, and the outcome of the arbitration claim was buyer withdrew. This was resolved several months ago.
******************** Code of Conduct violation was not a result of the arbitration that was mentioned in this claim. ******************** organization has purchased roughly 50 units since the resolution of the arbitration claim. The Code of Conduct violation was prompted by an unrelated transaction that violated Manheim's Terms and Conditions.Customer response

Hi,
This code of conduct violation was prompted a day after (05/12/2024) arbitration was opened for a vehicle sold to us with an odometer discrepancy. The odometer showed approximately ****** more miles than what was shown on the sale listing. Reference VIN for above *****************
Also, please note that in April 2024, we were threatened by GM ************************* to be written up for a code of conduct after we notified the auction of the frame-damaged truck sold to us and verified by an auction mechnic.*****************
These are just some examples we dealt with at this location under this management.
As for the code of conduct, we are still waiting to hear from someone who can explain why or what the association was against me if this was indeed related to the invoice submitted for transport, which we did transport the vehicle from the auction. If that was not acceptable, then when we sold a car at the exact location, and the buyer submitted the transport invoice for us in a similar way, why was that acceptable after I informed the *** ******, and he did not care? Also, please note that we have done business with Manheim for the past eight years and have never had any issues with anyone. This all started after the arbitration with the 2019 Jeep in January, where we made a complaint against the ** management for manipulating the arbitration policies, as you can see in the email I attached to this complaint.Business response

Manheim *********** has discussed the Code of Conduct violation with **************** face to face on two separate occasions, one being last week, when he came to the auction. Documentation has been submitted to him from the Code of ***************** as well. **************** acknowledged in an email the reasoning behind why Manheim submitted the Code of Conduct violation. There are no changes at this time regarding Manheim's decision.Customer response

This is again false information. I have attached references to this email.
When I went to the auction last week, I asked ******************* about our account's status. He stated he would follow up with the code of conduct committee, and that was all of the conversation. I followed up with him in an email, after which he acknowledged it few days after. The email is attached for reference.
In April, when I notified the auction of the frame-damaged vehicle sold to us, ******************* called me into his office and mentioned the transport invoice that was submitted for the ***** CX-5. I clarified to him then that we sometimes transport our vehicles, which uses resources such as employees, the cost of gas for the tow truck, and the trailer; hence, the invoice is for the cost of our time. Please note - this conversation was in mid-April. Since then, we have purchased over a dozen cars from the Manheim, and no action was taken from him until May until we opened an arbitration for mileage discrepancy.
As for the documentation from the Code of *****************:
I received two emails from the Code of ***************** regarding documentation. Both are attached. None of the documents states the cause of the code of conduct.
If someone from the code of conduct committee had called us, I would have respectfully explained the situation in Manheim ***********, and discussed the chain of events. As stated, I have done business with Manheim for over 8 years and never had issues with anyone. Please feel free to look at our account and make a fair assessment. The committee made a biased conclusion without considering or gathering all the facts.Business response

I am rejecting this response because Manheim failed to provide proper documentation for the code of conduct.The invoice which was provided for transport was buyers expense to move the vehicle from the auction to the dealership.

We are rejecting their response because they are not providing clear answer on why the account was suspended. Again, if the reason for the suspension was the transport invoice then why were we billed ~$1,200 when we were the seller. If you can please compare the transport invoices which was submitted for ***************** versus the one we submitted and let us know what is the difference and would like to know why are we being targeted.Sincerely,

A man named **** who owns Wear Master Auto shop in ******** ******** told me and my son that he would get my son an auction vehicle through ********. My 18 year old son gave him $5,200 in cash on December 2,2023. The 2015 **** escape never came into the state of ******** and **** said it was Mannheims fault and wouldnt give me the vin number and had no explanation why. He claimed Manheim wouldnt tell him. My son is still waiting for **** to return the $5,200. He claims the money is going to come from his manufacturing company. Its been almost 6 months. This company only gives a 1:30 min window to redeem your vehicle no matter the day. Which is unacceptable to people who lives hours away to come get their vehicle. Hours to come get vehicles is 12:30 - 2pm which is not accommodating for people who have jobs aka the entire world. People have to take off of work a whole day just to get their vehicle. The business also hung up on me when requesting the commercial line. They are very unprofessional and need to be investigated.Business response

I purchased the 2018 ****** Tundra VIN: ***************** on April 18 Manheim Atlanta. It was discovered that the vehicle was not present at the auction site. I was informed that the vehicle had been sublet to ****** dealer for diagnostics PRIOR to the auction sale. The misleading condition report 4.6 falsely indicated that the vehicle "runs and drives," concealing any known electrical/no start issues. The vehicle does not start, has codes for immobilizer and PCM issues.Contrary to what the condition report disclosed. Consequently, the vehicle remained inaccessible for transport for 10 days after the sale.Because the vehicle was still at the ****** dealer for diagnostics.Manheim failed to announce this vehicle was not presentl at auction during the sale.Manheim Atlanta and seller deliberately concealed to disclose no start electrical issues & withholding this information on the condition report is fraudulent and deceptive, as this issue was known before the auction sale day,Despite this being a "sold as is" auction, the condition report should have disclosed what ******************************* knew prior to the sale, but failed to disclose these issues by presenting a untruthful condition report rating 4.6.This level of misrepresentation and non-disclosure is unacceptable & goes against the principles of fair business practices for providing false representation of vehicle condition knowing prior this vehicle has electrical no start issue.This may constitute as fraud for misrepresentation. I request Manheim cancel this sale and refund all fees. Vehicle was purchased under false pretenses CR 4.6 excellent condition, listed the vehicle as Run and Drives.No disclosure for any mechanical or electrical issues even having prior knowledge PRIOR to the sale. Our company purchase a 2019 Lamborghini Aventador SVJ ,***************** on August 23rd, 2023 through ********. The price of the vehicle is $545,435 including $5,435 for buyer fee).On February 12th, 2024, we sent the vehicle to ************************* Lamborghini Boston for a full inspection and found that the vehicle has been Odometer Rollback by the previous owner. The cluster shows ****** KM, but it is actually ***** miles used per ECU. Please see supporting documents attached for your reference. Odometer tampering is a violation to the Federal Law under Title 49 U.S. Code 32703.We submitted an Arbitration claim for this incident on Feb 16th ***** MANHEIM agreed to buy back the vehicle for $46XXXX, which we need to bear almost $100,000 loss. We believed this is not a fair resolution since we are the victim in this case. On April 4th, 2024, we send back the car to ******** **********, it took them three weeks to complete the conditon report. On April 18th, 2024, they request vehicle send to LAMBO dealership for a full inspection, which was done at ************************* Lamborghini Boston. At this moment, the vehicle is still at ******** *********** possession and it is holding for the transporter. We are a small business owner and we lent the money to purchase the vehicle from ********, the delay has been indirectly cause the cash flow liquidity of our business and we are very close to bankrupt due to lack of operating funds.With all the facts, there should not be any reasons for ******** to hold the vehicle and refund. This, I urge BBB to step in and have this case resolve for us. Any helps would be much appreciated.Business response

Before Manheim can make a final decision on AMG Plus ********** claim, the vehicle will be sent to a dealership that can service a Lamborghini. AMG ************* was informed of this on April 18th as Lamborghini's are not easy vehicles to transport. This arbitration claim has not yet been resolved.Customer response

Date of transaction 04/17/24 I purchased that car with a CR 4.2 and a green light. Decided to resell it the following week, and somehow the new CR became 2.8. Way more damages suddenly appeared. The car has never left the auction site, just ordered new CR. You can guess what happens next. The bids were way too lower than the bids when I bought it the previous week. I was advised to send it to arbitration. Arbitration were no help at all, saying that is not their mistake.Business response

Manheim *************** has investigated Garage 57's claim and they are confident that it was handled correctly. The buyer (Garage 57) was physically in the auction lane when the vehicle was purchased, and therefore the transaction is considered "Inlane". This has several implications:
-The buyer can physically inspect the vehicle to note any cosmetic damages and observe how the vehicle performs. Therefore, we do not arbitrate based on Condition Reports.
-An Arbitration on an Inlane sale must be filed on Sale Day. Garage 57 filed the claim on Day 8 which renders it invalid. This restricts Manheim's ability to assist.As a gesture of goodwill, Manheim *************** refunded Garage 57's buy fee on the transaction in the amount of $635.00. However, the decision regarding this claim remains buyer bought.

As an eager car buyer, I was tring to buy on ove with hopes of finding reliable vehicles for my dealership. However, what I encountered was far from satisfactory.Upon purchasing a car from Manheim Auction (OVE), I expected transparency regarding its condition. Shockingly, it wasn't until after the purchase that I made a horrifying discovery: the presence of HUMAN blood within the vehicle, constituting a severe biological hazard without announcement .The failure of Manheim Auction to disclose such a critical detail is utterly unacceptable. A reputable auction house should prioritize full transparency, ensuring buyers are fully informed about any potential dangers associated with their purchases. By neglecting to disclose the biohazard in the car, Manheim Auction has not only breached trust but also endangered the health and safety of consumers.Buyers should be able to trust that the items they purchase have undergone thorough inspection and accurate representation. Purchased a vehicle through Manheim Auto Auction in Manheim ************ on November 3, 2023. I was advised by the auction that the title had the incorrect mileage on it and asked if I wanted the seller to correct it. I said yes because it would cause problems here in ********. She, the representative from Manheim, said ok and that it would take a month to get it back. I said I was fine with that to she started the process.We have called the auction and the dealer that sold us the car through the auction, repeatedly. We have been lied to over and over. The seller has stated that the title was at the *** and he was just waiting...so, finally, we decided to call the New Jersey ***, where the title is registered, to see if he was telling us the truth...The title was never filled and Manheim Auto Auction will do nothing about it. The seller will do nothing about it. The resolve we are looking for is a valid title for the car we purchased. It has been over 5 months.Business response

Manheim PA has been actively attempting to correct the mileage issue for this vehicle since it sold on November 3rd, 2023. As of March 22nd, 2024 the New Jersey DMV indicated that the mileage has been corrected. The original seller is waiting for the corrected title from the New Jersey DMV. Once the seller sends the corrected title to Manheim PA, it will be forwarded to the buyer, JOELSCARZ.COM.Customer response

I contacted the New Jersey DMV on 4/9/2024 to check if this had been done and they indicated they have no record of the title being turned in to them since November 2, 2023. That was the one with the incorrect mileage. We have been being lied to by the seller and Manheim since then. The selling dealer continues to lie and Manheim passes the lie to us. When I asked for the title as it was with the incorrect mileage, they suddenly came up with the lie that it was already corrected and they were waiting. It was immediately after this, I called the New Jersey DMV to verify....another lie. I also pulled CarFax and AutoCheck which would also indicate if the mileage had been changed...nothing showing it was changed.Business response

Another day and another fraudulent incident.I purchased a 2014 Infiniti qx60 from manheim. Vin # ***************** I purchased the car and it had a condition report of 4.4. Thats an excellent rating by all measures.I never took the car off Manheim property. It's been at manheim chicago the whole time.When I try selling car now, the condition report magically became 2.8. How? Why? The car never left manheim property. Lot of explaining to do here because once again this is fraud if your helping a seller by boosting a condition report and then magically after its sold the rating changes. After reviewing *********** claim, Manheim Chicago found no evidence of fraud however there is evidence of additional scratches, and dings on the second Condition Report. It is possible that this was missed on the first Condition Report or while the unit was on Manheim's property for two plus months. It is common for Condition Report grades to differ from one Condition Report writer to another. *********** purchased the vehicle with a Condition Report grade of 4.4, and *********** then sold the vehicle with a Condition Report grade of 3.7.
